Hi guys,

 

My birthday was coming up so I decided I was going to get a n/a zx, as I owned one a few years back and always regretted selling it. Two weeks ago today I bought a white n/a 300zx from Paul at SWZ (this forums registered trader) after seeing the car on ebay.

The car was described as 'A nice drive, mechanically sound with a tidy interior', when i picked up the car the exhausts were blowing very loudly even though it had just passed an MOT that day.

I paid for the car and didn't haggle on the price as I believed I was getting a good car. The car didn't even make it home, after 140 miles the car started to misfire and splutter. We pulled into the services and opened the bonnet to hear the bottom end knocking. I phoned Paul straight away and informed him what had happened, he was very apologetic and told me we would sort something out.

The next day the car was recovered to my workplace at a cost of £140 plus vat. I spoke to paul again and he agreed to send me a replacement engine at no cost that would arrive on wednesday 6th August. On wednesday the engine did not arrive and after ringing Paul's mobile 8 times with no answer I called his land line, he answered 1st time and he told me it hadn't been sent yet but it was going out on a pallet that week ETA monday 11th.

Monday has been and gone so I tried to call him again, 3 times no answer. Then I receive a text message saying he would call me later, later on that day I received another text saying the engine has been picked up. I text back asking for an ETA or the couriers details and i would speak to them direct. The reply was 'Will find out tomorrow but i think its pallet direct'. I cant find any details on a company called Pallet Direct. I'm not getting an answer form Paul's mobile or his landline and he is also not responding to my text messages either, even though he was posting on this forum at the time when I called him.

 

So here I am two weeks on and all I have to show for my money is a dead zed. Further investigation into the car I also found out the heater matrix has been by-passed.

 

Where do I stand with this and what would you do?

Take it back for a full refund mate. how did you pay? If it was on Credit card get them on the case for a refund, they have a lot more powers and go in gard.

JOE when i sold you the car i even drove it 30 miles to you and you looked around with it running and were happy with it. You then proceeded to speed off to the petrol station very fast and if im currect drive much like myself with a passion for drifting etc but this is becides the point !

 

You bought the car as it was and was fine when i drove it and when it left me !

 

So when i got the phone call more than 3 hours later i was suprised and said i would sort something out etc which i have. I have removed a known good engine from a car i have i have here and sent it out to you FREE at a cost of £70 delivery cost plus the engine £300 and my labour time as a good will gesture. the engine was sent out yesterday as you know and i have replied to your text today before you come on here accusing me of having you over.

 

Let me just say the car was sold as seen and was in good working order when you picked it up from me after i had driven it 30 miles out of my way just to help you with journey time because you got stuck in traffic.

 

If i was worried about the mechanical side of it would i have driven it to you ?

 

If i was gonna have you over would i send you a engine FREE

 

and not at 1 point have you asked for your money back !

 

Plus you said you were gonna send me a video of the engine running in the car to confirm it was knocking which you haven't done so how do i know you dont just need a engine.

 

so all in all i traveled 60 miles for you for removed and sent an engine free and your still not happy what more can i do you tell me ?

Im sure he'll sort something out mate, might be having problems with his phone or something bud but im sure he'll be along to sort something out for you

how many people can get me on the phone ? you know its like :headvswal as i leave the bloody thing everywhere and am always underneath a car somewhere plus i may appear online but its not me at the controls LOL

For starters, I dont think these sort of disputes should be conducted on an open forum.

I never said you did paul, i just dont agree with these sort of things being discussed on an open forum. :D

If Paul is happy for it to stay on here in the open - so be it, sometimes the only method of comminucation is the forum (when phones don't work and pm's are not available)

 

If you do want it moved just yell

When I first read this, I thought to myself ?. I doubt that Paul would sell a car knowing that it had a problem.

 

Then I was asking myself, did this guy not check the car over. If the problem came to light after 140 miles, how was Paul supposed to know that, it was fine when he had it and it was fine when the guy picked it up.

 

Personally, I think you should count your lucky stars that Paul is offering to sort it for you free of charge, there's not many people around that would do that.

 

You probably just pulled a coil pack loose or something hense the misfire.

Not taking sides or anything here, but remember Paul sell cars as a business and is same as if you buy anything from a retailer, there is comeback if things are not right after sale.

 

If it were a private sale they I would agree 100% with you, but if I bought a car from a garage and in under 200 miles died it would be back for a refund/fix without a shaddow of a doubt. And if it didn't happen willingly I'd have get the law people involved and I know for a fact then it would. :smash:

Not trying to protect Paul here at all, I mean god knows ive been ripped off by loads of traders including traders on here!

Personally I would be happy if someone i'd bought something off got back to me and offered to sort it out straight away for me.

Paul asked for this thread to be brought back to light as he doesnt want anyone thinking he has anything to hide by getting rid of it.

 

not once has Joe asked for his money back because if he had Paul would of given him it, he is happy with having a engine but was worried because he couldnt get hold of paul at that time. Paul has spoken to him and things are sorted as his engine should be with him by now so no news is good news.:)

Not true. If you buy from an auction (and that includes Ebay) without inspecting / trying the car beforehand then you have no legal rights at all if something goes wrong, even if the seller is a trader / garage. That is the reason why people send items to auction, if and when it sells, providing it was not misrepresented, then you are legally bound to pay for it and any rights under the Sale of Goods Act do not apply.
