I was driving no more thaN 2O MPH at bout 1pm today when a girl reversed out of a parking space causing me to spank the rear right of her bumper. i quickly ran after some young bloke who seen it and asked him to be a witness i took his number.

 

when i got back to the scene she was shouting f'ing and blinding, she wasnt happy.

she said why wearnt you looking where you were going couldnt you see i was pulling out??? What the fook???

she said its not her fault..... has she gone mad?.

i asked for her deatails but she wouldnt give me them and atempted to drive off so i had to stand behind her car to prevent her from getting away. at this point i rang the police, and vola she started to co-operate. i handed her the phone to the police she said it was my fault. but i had already told the police she tried to drive away and it was happening while i was on the phone to the police.

She eventually calmed down and we swaped details.

she said she had just sold the car and was buying a bmw and that this would mess up her insurance. AH now i see.

she offered me 100 quid to call it even. has she gone insane? thats not guna cover it. I said its guna cost more than that love. So i said il get a quote and let her know the damages and she can decide to go through insurance or not.

 

Ive been to my friends garage and he said it would cost £350 to get it sprayed. he then said if it was to go through insurance it would be priced with a new panel. which in total came to 185 for paint and 360 labour.

 

So its up to her whats shes happy to do.

i tried ringing her an hour ago to let her know the quotation but i left a message.

im so annoyed why cant people just admit to being in the wrong.

she knows it. I can see this one being a very long process.

 

When i pulled of it was obvious what she had done as my tyre was rubbing on the plastic cover under the arch, i had to get out and bend it back.

 

oh and guess what her name is????? TRACY

Like i said il give them a couple weeks and if i hear nothing back il contact a ombudsman and clog your inbox with pm's :D

just to add...althought the insurance company itself will have an 'ombudsman' themselves who is supposed to look into this, there is nothing stopping you from contacting either the Financial Services Authority or the Financial Ombudsmnen Service to see where you stand so far. They can often advise you on what further evidence you require for them to look into it properly.

 

The FSA basically requires ALL insurance companies/banks/mortgage lenders etc to comply with their rules and regs promising to not take the p out of consumers and in return they get the priveledge of trading!

 

The FOS are the ones that actually look into any consumer complaints. They are independant from FSA AND the insurance company so they will consider both sides equally. Once they decide, the insurance company HAS to comply (if they side with you). If they side with the insurance company, you have no further recourse. They are the last line of defence unfortunately.

 

Have a whizz on the website for the FOS (google search) and take down some details of the process to file a complaint and reel a bit of this off with the insurance company the next time you're on the phone. Hopefully you've been keeping notes of dates/times/names of contacts for all your contact so far. This should give them the eebie jeebies into sorting something for you.

 

I did something similar last night with my orange contract problem and it seems to have worked...but will find out for sure tomorrow!

You may be aware that Jo is on holiday until the 4th of July, I have been dealing with some of her files that she has diaried.

 

I have spoken to the Third Party Insurers again today, they are still disputing liability (unsure why, as they will not advise of their alergations). Jo has sent your estimate and witness statement to them which TPI should be reviewing. At this stage there is nothing else we can do but wait for TPI to finish their investigations.

 

We will contact you again when we know more.

Its sh1t when it drives you to that stage bud. At the end of the day if it gets too much, you just have to call it a day :( I'd love to tell you to keep going with it, but it's you thats going through all the hassle.

Dont give up whatever you do or you can kiss goodbye to getting anything. If she is found at fault then there should surely be some consideration for the time and expense that you have gone to in making this claim and the stress caused.

Insurance companies in all but one of my experiences always look at how not to pay out first.

If you had taken her number plate got a witness and let her drive off like she tried to she would definately have been screwed, one call to to the cops then they could have had her up for a hit and run or something like that. Im sure her employer would not look highly on such behaviour either.

The point is there ars so many people that will just never admit they are in the wrong when they are and its often honest people that have to suffer. I hope you get paid out and that she gets all that is due to her, higher insurance premium and an excess payout etc. Grrr. dont take any crap mate good luck with it.
