My son has just got a fixed fine for not displaying his tax disc, the disc however was in the windscreen but on the offside. The reason for this is that the holder had come loose and he had temporarily wedged it against the screen behind a pod mount for his boost gauge. Obviously the police when inspecting down my sons road were only checking the n/s of the vehicles! Is there legislation in place that states placement of the tax disc? :confused:

yes - it has to be nearside, out of the sweep of the wipers... you could try a polite letter with pictures explaining it had been done that day & why - and if he's got the time/ balls, then go all the way to court as it's unlikely the CPS would consider a prosecution to be in the public interest as it was only a technicality.

 

The police will also know that it was taxed from the central database.

if he WAS displaying the road tax, and HAS road tax, and the police CAN check this, i cant believe just because it was on the 'wrong' side they can fine someone, rare instance, but shocking, also didn't he have better things to be doing? I'm sure the crime rate in this country are increasing, with the road tax not displayed correctly can't have been a priority?!!! :rant: rant over lol.

Thanks for the help, around here the police have regular drive by street sweeps probably checking the n/s of vehicles from the comfort of the seat of the police car :D as they drive along. As mentioned, the car was taxed at the time but apparently the disc was unnoticed/ or the policeman was a complete arse and decided to prosecute after noticing it on the o/s anyway. Ah well, its good to see the local constabulary out there clamping down on these villains aint it! ;)

The offence is for non-display, irrespective of whether it is actually taxed or not, you will have to pay- been there done that. waste of energy to fight it. move on in my opinion.

I had the same problem and went to the cop shop ranting and raving at the desk sergent, once i had calmed down the officer told me just to write to the to the address (i think is on the ticket)and explain that one of my kids was playing in the car and had moved the tax disc, (mine wasn't even on show as it had fallen down) the sergent was very helpfull and i felt a bit of a div afterwards. The result was the fine was cancelled. Go to your local police station for advice first as most police are happy to help.

Totally agree, as soon as i win the £95 million euro millions tomorrow i'm out of here.

When i was ticketed for my tax disc it was on private property and the cops were only there to check out a stolen abandoned car. It was only when i went to the police station that i found out unless security gates were in place to prevent the public entering the "private car park" it is still considered public highway.
