ive had it twice now, i used to think it was a scam for compo

thing is now, when i sit for too long or sometimes when i wake up, i get a really sore neck and headaches, i never used to get them till i got wiplash through accidsent no fault of my own

 

anyone else get this-who has been involved in an accident, makes the £1000 pound compo seem a bit trivia compared to the headaches i get

I use to have a headache once or twice a week due to whiplash from years ago, its taken a lot of my own money to find out why I got them and how to help with them, I have accupuncture to help, it was starting to take over my life so I know how bad this can be.

i can controll the way they are, certain ways i sit, drive and sleep can help, but they can make me ratty as hell lol

same here, my neck locks up if i look at anything to the right of me for a length of time. (ie watching a film) All happened after a car collided into the drivers door of my escort.

 

still happens now and its nearly 3 years on.

i can, but i still get headaches lol, not so much strong, or a good drinker, and im knacked after ten mins lol :D

I used to think it was a scam too, when you are in an accident/shunt sometimes you don't realise you've been injured because the adrenalin is pumping, its only later when you've calmed down does the pain hit you.

we had someone hit us in stationary traffic wrote our transit off ,,had to see a chiropractor for twelve months twice a week 6years later i still get same pains headaches and will for the rest off my time , but got a good payout for wiplash and suffering 25k although it was nice to have the money would rather i didnt get the headaches ..im sure you'll agree

I really dont understand why, once you have claimed for whiplash you can never claim again in another accident?

Ye I get the same mate. Still trying to settle at mo with our accident. So you accepted first offer of 1k? Did you have any physio for it? We were offered 1k before my 3 mths physio, now they are offering £2,200, how far do you think I can take this as still get aches n pains alot

you can keep going. As a rule i used to tell my clients to kep refusing the first few offers as they will offer you the lowest to test you a bit. Your lawyer will advise you on when he thinks you cant milk any more out of them to which i strongely suggest you listen too.

 

the thing with these claim is the more you throw at the wall the more you will get to stick. you need to mention all the losses you made due to injuries, this includes take aways and taxi's and even inconvenience i.e you couldn't pick up your child or even make love to your partner, these ALL count.

 

to those who think about claiming for accidents:

 

Always make sure you get 100% compensation, the way it should be done is that a company has a list of lawyers that take out money from a pot which is like insurance against your claim. The lawyer uses this money to fight your case. if ou lose they get their money back and you don't pay a thing, If they win you get the 100% compensation that the court decides.

 

Once you have your money the lawyers receive their money back that they put into the pot and an additional award fee of 50 - 100 % of the winning that you won. so if you got 3k they will receive 1500 quid ontop of the money they got back. This is how they make money..... unfortunately some big companies will also take a percentage of what you earn't out of your winnings,

 

best thing i used to do is tell our client how we differ so i guess if you do claim then please ask how they earn their money, as a good company will tell you what i told you.

Well my lawyer says in letter that maybe ask for bit more like £2700...but i still feel this isnt enough for all I have been thru, would like to settle around £5k really, but if goes to court I could end up paying the fees. Didnt think it worked like that that you can say an amount to them as I would rather not state an amount..

well i haven't been aware that you can ask for an amount. you could try but i wouldn't suggest it. however i havnt been in this job for 2 years and the laws constantly change. i would still check with another lawyer tho as last time i worked for this you could only accept/refuse what they offered instead of asking. Like i said... if you put down as many reasons for losses of earnings or family time etc.... use them as it may help you ask for a more reasonable amount of money.... depends on your lawyer as some will do a half assed job just to get quick money

when i worked.. i knew that most lawyers wont even take on a case unless its worth a minimum 1500 quid. some go lower but not much. the minimum you can earn and average win is 1500 - 2500 for a whiplash so any more than that is even better for you. unfortunalty its hard for claiments to get any more than that unless their suffering has been extreme.

Ye thought was a bit odd. Will make appointment on monday to see her. Wow300 has been offered the same and hasnt had physio, but chose to claim b4 physio and have that after

once you have claimed you cannot claim again.... this applies if you have allready won as this prevents claims going out of control ( like they already are). you have usually 2.5 years to claim as it gets harder for them after that barrier. make sure they are doing something because i have had many a people chase me down the street when they realize what i worked for and they had bad experience from cowboys previously. once your signed up to that lawyer you cannot go anywhere else so make sure they are doing their job.

last bit of advice which i forgot earlier. never do your injury claims through the car insurers service, i know you get the service free ( sometimes ) but they are not as good at getting money as most don't account for suffering and expenses (financially and emotionally) always do your injury claim separate from your vehicle insurance claim

I had a crash and my claim has been put forward as moderate whiplash with social something or other... looking on the net, moderate whiplash has a figure of 4k next to it? whats the likelyhood of me receiving a figure like that?

I'd get your neck scanned mate, you may have done a little more damage than just whiplash.

 

Whiplash only lasts a few weeks while the muscles in the neck repair themselves.

If you have a slipped disc in you cervicle vertibrae or even a trapped nerve somewhere, this is more than likely to cause the headaches.

seems good. like i was saying to lisa.... law changes fast and lawyers exploit this to their fullest. it used to be 1 & 1/2 inch of pavement sticking up that you could claim on council if you fell over and injured yourself. One lawyer got away with 1 inch and so more claims happened on that number. last i heard it could happen on just half inch. The same goes with the money, i suppose if lawyers start getting higher awards then the average awards will rise. i was last in this job two years ago and it was amazing how many times i had to change my investigations due to the laws changing so much.

 

If they are a legit company then it might be accurate.... however make sure they are saying its your compansation 100% or they might be meaning that the award will be 4k before fee's

 

anything else you need help with then just ask.

 

p.s whiplash can occur anything up to a year after the initial time of injury

Wow300 rang solic today, asked her 'hows does it work giving ins company a figure?' never heard of that b4, she got a bit funny and said ' i do this job everyday', so he said well just go back to ins and tell them i am declining and ask them to make an offer. She said oh...ok if thats what your instructing me to do. he then said ' yes please' that was that. What do you make of that Damien? is she acting odd or not?

just so i understand, it now sounds like this hasn't gone to court yet. hmmm its hard to say what she is thinking as all lawyers, solicitors have their own way of doing things. Obviously you need the most money you can get without going silly.

 

My boss sent me this when i first started the job, just found it in my old claim books ^^

 

The purpose of her making the offer is to speed up the claim and reduce your legal costs.i cant remember the jargon for this proceedure. Your solicitor should ask for your confirmation that you agree to it being made.

 

The offer remains open for 21 days from the date your opponent receives it.

 

If your opponent refuses the offer, and you press on to trial, the court's award may be better than the offer the third party insurance made. If so, the other parties insurance will have to pay a higher rate of interest on your damages, and extra legal costs.

 

Your oppenent may offer a figure, backed up with a payment into court, which puts you in the position of deciding whether to take a gamble on beating their offer.

 

Remember that the compensation is for you. You are entitled to know what deductions, if any, will be made from your compensation.

 

so really it sounds like she is shoving you through the door as quick as possible to get the next job in, as some of these claims take up to a year + to finish.

 

If you are not paying conpensation then this might be the better offer unless you happy with the price.

 

If you are paying them a percentage then i would suggest looking into following her advice as this will mean you will get a quicker payment, although this could more than likely affect your reward meaning you may not get what you want, But the thing is ... if you are paying a commision or such.... the more you win, the more they get off you

 

It's a hard decision and i don't want to risk you not getting th most out of it, so i guess the only thing i could advise is do what you feel is right and make sure she keeps you well informed

Ye I feel she is trying to push us thru the door so to speak...so what wow300 is doing is the best way? By not stating a figure them its up to them to offer, ye? My back will ache for a long time to come I think, but she says no further physio available til after July(1 yr mark) which the doctor predicted that I should be fully fit by. My chioce is do I let them offer again, then I can refuse if not satified them leave open til July or will they automatically go to court after next offer?
