For anyone who has followed my posts on warranties you may like to know how things have gone so far,

 

1. Car loses drive oh fuck this is bad

 

2. Contacted Warranty holdings who i thought i was covered with.

 

3. They have no record of my policy ie dealer not sent in paperwork and fee.

 

4. Try to phone dealer, no answer, try mobile, voicemail i leave a message asking him to contact me

 

5. He doesnt

 

6. Drive (a friends car mines fucked) to his premesis which is all shut up, speak to the people in the neigbouring units who claim to not know who he is where he lives or how to reach him etc etc etc

 

7. Hang on, i paid by building society cheque so i have a name.

 

8. Phone home get brother on internet to look up on electoral register all persons in that area with that name.

 

9. Drive to each address only to find the first one with two high powered jap mobiles outside, i think this is our man!

 

10. Phone him again, voicemail, this time i leave a message saying that i have tried to contact him to no avail so i have had to come look for him and im now standing outside his house and tell him the address!

 

11. Within ten minuites he calls meto see whats wrong i tell him about knackered car invalid/no warranty car sold under false pretences, trading standards etc

 

12. He tells me if i return the car i can have a full refund

 

Now the only problem i have is how to get an undriveable z 50 miles and is it going to be as straight forward as it sounds? Should i demand that he collects the car from me? after all hes the one who gave me a hooky warranty without this i have no AA cover. How do i stand on the money ive poured into it ive only had it two months and given it four brand new tyres, six months tax, sevicing costs etc ive worked out ive spent £600 on it (obviously petrol and insurance excluded) and i will in effect be giving the car back in a better condition than when i bought it, so should i push for more? MOre to the point ive got all the hassle of finding another car (z or not i do not know yet!!)

 

Oh what to do,

 

Im not counting my chickens until i see the cash but it cirtainly feels like im getting somewhere now.

1Do Warranty holdings have details of this dealer?(Is he allowed to offer Warranty holdings warranties?)

 

2Can this person get your Z repaired under the warranty you were supposed to have?(i.e. he calls Warranty holdings explains the situation, Warranty holdings auth repair and setup your warranty?)

 

3Do you know what the problem is with your Z and would Warranty holdings pay for it if you were covered(Warranty holdings booklet lists whats covered if you got given it)?

As you said, if you do give the car back he will be getting it back in better condition, you could prove what you have had done and try and get him to compensate for your costs (but I doubt that he will).

 

Judging by the effort you had to go through to find this guy and get him to speak to you he dosnt sound like he can be trusted, have you asked trading standards/citzens advice on where you stand i.e. can you get him done for "invalid/no warranty car sold under false pretences" as you said?

But as he has offered you a full refund it seems like the easiest option would be to take the money and get another car from a more reliable source, but:

You lose the money you have put into the Z (unless he sorts you out).

 

You will have to try and get him to pick up the car, or you will have to pay for the 50 mile relay to his site.

 

You end up with no car(not sure if you use it to get to work etc) so have that hassle.

 

(Note: If you can get the car repaired via Warranty holdings you may get a courtesy car)

Rip the tax disc out and send it back to the DVLA. You can get a refund on the time left. Try get your car to a tyre place and ask if they have any worn tyres to put on your car again and keep the new ones for another Z, (If you get one).

I would get the problem diagnosed first, so you know what your dealing with. If its terminal, then dont mess around, get your dosh back. I would get him to come to you and give you cash. dont take the vehicle to him, too risky, this guy souonds dodgy as fuck.

As you've made a bit of an investment in the car I assume that you like it and would prefer to keep it. If that is the case then I'd find out what's wrong and what it'll cost to fix then work with matey to get it put right. So either he sorts it with the warranty company, or he makes a significant contribution towards the fix (at a place of your choosing!).

Why is it your job to get the car to him?

 

You would be better off getting the money off of him first and getting him to pick the car up.

 

Imagine the scenario; you eventually get the car to his place and he says, I can only give you a cheque, oh and by the way i'll have to take some money off for... (he invents some spurious reason). What you gonna do then? Trust his cheque.

 

Do you think he is just going to have the cash waiting?

 

Get him to pay you first and when the money is in your account or he comes up with cash give him the car and put some shitty tyres on it.

 

I would also inform trading standards and/or local council, regardless of the outcome.

Managaed to speak to him again today i left him a message and he phoned me! Told him to pick the car up and he said ok and i told him i wanted at least the money for the tyres and tax as they are brand new. He's on about comming sunday, now the only thing is that my bloody reg plate (B19RKS) is on it and i need to get it off sharpish!
