seems as if they REALLY do try it on

we got a nip in november for the missus, so i thought sod it ill apply for the photo (you now have to pay £10 :xxx: )

and lo and behold this morning it turned up, and how the hell they can prove who was driving, i wonder how many others have just paid cos they assumed they were nicked?

well thats just saved her £60 and 3 points

i went and checked the road as i wasn't even sure it was a 30mph as its a country road, although i did ask her did she not see the copper and she said DEFFO not, looks like hes a tree hugger who jumps out after you have passed :mad:

Donno about english law but I know a very good solicitor who will get anyone off any speeding GATSO front or rear photo, In Scotland at least. MSG me and I'll give you his number.

What about a caution also. When you are charged with any offence, you should also be cautioned under the Police and Criminal Evidence act (PaCE). You have the right to remain silent etc. The Road Traffic act removes your right to silence by stating that you MUST identify the driver, if at all possible.

 

 

As far as I can remember (and it's been a little while mind you) Speeding isn't actually mentioned in the road traffic act, and upon quickly glancing through it I can't see it mentioned anywhere. Also the caution is "I am arresting you under suspicion of ******, you do not have to say anything however it may harm your defence if you do not metion when questioned, something you later rely on in court anything you do say may given in evidence"

 

It pretty much says that you don't have to say anything, but you not saying anything may be looked upon badly in court.

and cough up, did i read once you were trying to save money on getting your car alarm fitted?? and only relented when it became an insurance issue?

The police can not use the photo to identify the driver.

 

I had a similar csae and I just sent it bc ak saying I didn't know who was driving.

 

Didn't even ask for the photos because if it went to court I could have at least relied on that to perhaps get out of it.

 

I didn't hear another thing.

 

Thing to do is to at least have your day in court. If we all did that then the justice system would come to a shuddering hault as there is no way it cope.

I'm not saying I never exceed the limit. Like most of us I always try to drive at a SAFE speed which is often more than the speed limit but when I am CAUGHT doing it I don't try and wriggle out of my punishment - I have a bit of a moan but put my hands up and say "fair cop" and accept the points and the fine. I don't understand why Billynomates is becoming abusive and personal, I am only stating my opinion as we are all entitled to do, I'm sure he and his wife are lovely people, I just don't agree with their views on this occasion.

quick change of subject but how long is it they have to send the ticket out ? 14 days? i thought i may of got caught a week and a half ago but not had a letter yet, will be 2 weeks on sunday

i'd just take it, you might as well at the end of the day.

 

It seems like a load of hassle to try and get off it to be honest, i took mine and haven't speeded since (well occasionally but i'm much more causious now)

although saying that i think i may just be about to get 6 points on my licence :cry:

 

didn't realise there were specs cameras on the road i tore up in nottingham on monday night when some twat was pestering me. i think i may have touched 50 in a 30 zone for a short distance.

 

the whole road is littered with specs cameras i didn't even notice :rant:

 

Oh well, my stupid fault, i had a bad feeling about going out for a meal monday and what happens?

 

I get points on my licence,

 

I end up with food poisoning

 

& miss going out with a girl i've fancied for a while now.

well... i just got a letter saying no further action on this speeding case, not going details on here obviously!! but yes.. dont just sit back and accept it... be brave ;)

well after replying to their letter with the photo that we had made EVERY effort to try and suss who was driving, ie the reason i had asked for the photo was to try and identify who was driving but as it was rear facing it was no clearer,

i had checked our cards to see if either of us had bought petrol that day, i said i was at a loss if i could help them further, i have now received THIS

Innecent till proven guilty, and they cant prove you was driving, so cant take you to court with no evidence.... :hyper:

No, course it's not. The NIP goes STRAIGHT to the registered keeper and they DON'T need to photograph the driver. What happens at night erh?

 

OK Si you pay the fines when you get them and you will.

 

However I haven't payed any and although been a ball ache got no points on my wifes licence.

 

Six in 4 years and + she has a snooper which she turns down because it anoys her. She's not a loonatic but strays a over the limited as we all do.

 

There are cars out there that a ringers etc and just genuine situations where 3 people my have use of a car and carn't remember who was driving it.

 

When we go to our Caravan near Pothmadoc. Sometimes we have 4 cars ther. I go staight from work and the wife and kids go straight after school and the outlaws are there. So it a cas of the last car in (Zed not included) get driven by anyone who want to go to the shop etc. We don't keep a log as to who drove between what hours.

 

They must be able to prove who was driving and if they can't they have no case. Thats the Law. Most of the forms they have and what the CPS state as law on them is infact untrue.

just goes to prove a LOT of people just bend over and accept the shafting

thats without going into the ins and out of whether the photo is accurate,

as thats all it is a photo with her car on it and a speed

its not as if this road is a busy main road, its a country road, with a house/farm dotted about, and obviously a copper hidded behind a tree :slap:

Thought i'd post up that there are various rules for the use of guns and mobile cameras etc Not only was yours from behind, which i think you pointed out must be from the front, but it's also on a bend which would significantly vary the reading!!

 

I read alot about guidance at http://www.pepipoo.com which is a great site for advice and assistance...
