Long story short, i made a guy an offer for an item on ebay on the grounds that i wanted the item earlier than the auction was due to finish. I made a good offer and we both agreed to end the auction and i would pay the cash to him.

What happened was over the weekend i didnt have lots of internet access and the auction ended with someone else winning  I have sent a few messages to the guy i supposedly brought the item off asking WTF is going on but had no reply. Basically (fearing the worse!) wondering where i stand as the cash was sent via paypal ?

Advise please

I know ebay have rules that say you shouldn't end auctions early and you arn't protected. Maybe you have some comeback on paypal though, but this is actually ebay as well I think. He's still taken money from you regardless of ebay rules so you should have some come-back somehow.

Thats what i was hoping, surly its stealing which ever way you look at it. Ive sent an email mentioning legal action so lets see how he takes it from here. Thanks for the advice guys..

What would normally happen is the following:

You win an ebay item, you pay for the ebay item and the ebay item is delivered and job is a good un. But if you pay for it and dont receive it then you can claim the money back through paypal. They automatically protect you for £105. (I have been stung on a £180 phone, but at least I got £105 of it back).

But as the item was not ended for your bid, then I am unsure on where you stand for this. Ill ask my m8, he should be online. He works for ebay.

great thanks mate if you could. Im looking at loosing £87, so not huge but enough to pi$$ me off. Its all adding up as the guys paypal address wont accept emails either looks like ive been done!

My mate replied with an email:

"Right pretty straight forward. If he doenst get news from the seller after 7 days get him to file a paypal claim. Other then that get him to buy all the guys items then request his contact details."

If its £87, you should be covered by Paypal by their £105 insurance. Like Ian says, give him 7 days to reply etc, then if still no reply get onto Paypal, they are actually quite good and quick.

Also make sure the guy knows that you will be contacting paypal to get your money back etc.

You can actually request the guy's registered details from e-bay.

You need to go into the community sectiona and you will find it. i did it once when someone tried to shaft me.

I got his details and sent him a friendly note ??

It automaticlly sends your details to him as well when you request it so watch out !

I dont think ebay will give out the details as there is no contractucal link between them. That is the stumbling point
