I cannot see how a jury would find someone guilty on those circumstances alone. I would say someone is not telling the whole truth.

IMHO the guys crashing the fiesta is a fault, who cares if they were racing. the guy who was in control of the fiesta caused death by dangerous driving. other motorists do not come in to play.

The Fiesta.......in a speed excess of national speed limit.

.....the Nissan was travelling at an average speed of 90mph

 

Call it Racing or showing off or anything else, it's the same thing in the end.

How could these two cars be truly racing? A Ford Fiesta Zetec S with around 115bhp would stand absolutely no chance on god's green earth of keeping up with the high powered 200SX pushing around 200bhp.

It's still Racing even if you're going to fooking lose!!

from the first link. it seems to me like they were racing and the guys in the fiesta drove beyond his means. so in my mind the guys in the fiesta was at fault. i know they were both speeding, but there is a limit to everybodies driving and you have to know where that is.

if i was to race somebody and come sideways into say a lamppost do you expect me to sue the other guys becuase he made me do it? you crash your fault IMHO thats the way i see it.

 

the guy seems to have pled guilty becuase he feels he had a part to play, which he did, but that is not the point. the guy in the fiesta made a personal decision to race so should accept all consiquesces even if he is dead

About 6 months ago i was speaking to his mum who was getting sigs together and the main evidence was

 

1 he made a phone call while at the car park and then one to call the ambulance and the distance was calculated to determine he rough speed

2 there were 2 people who said he was "racing" a women and a taxi driver

 

He was "advised" by his solicitor to plead guilty to get points or a poss short ban and was never told he could be looking at serving time

 

At no point did he overtake the other car but just followed it!!! how often do you keep up with a car in front?? not to race but just keep up?

 

The other car was faulty???

 

Still amazes me that someone can be blamed for the person in front going too fast and having a faulty car??

i think the judge said he was to blame as he had a much more powerful car which caused the other driver to drive his car beyond its limits and his means!!??

 

prob coming from an old to55er who wears a stupid white wig, drives a volvo estate and has never been over 15 mph ;)

Things like this make my blood boil, he obviously had a good job and contributing to the country to own and run a 200sx and to plead guilty he sounded remorseful and will probably feel so bad about the crash he will never be the same.

 

So tell me this we hear all the time about these SCUM who repeat offend with NO remorse mugging, Criminal damage, stealing cars and causing havoc on the road, beating someone up for no reason and disabling them. But these SCUMBAGS get away with it or get community service at the most, why because the Scumbags with social degrees AKA as DO-GOODERS defend them and make excuses for them “ they know no better”, “they had a bad upbringing” and “they are misunderstood”.

 

Ball's they are ruining the UK they put a strain on the country as we have to fund it while they are punishing People who would NEVER dream about knowingly commit a crime just have having a bit of fun when Shit happens.

 

This country is a joke and the majority of the UK think the same way, so why do we put up with this crap.

I agree with you Deve, something ain't right, neither could I offer support for a complete stranger who I know nothing about.

Look at any road, there will be two (usually more) cars one after the other exceeding the speed limit, when the one in front crashes how is it the fault of the car behind? Only if they both are young, with sporty looking cars (I’m 43).

 

Had they been two Volvos with 50 years olds driving at 90mph, then the guy behind would have been a hero, and the Police would have said that his good deed meant that they would turn a blind eye to the fact that he was speeding.

whether on the advice of a solicitor or not

he hasn't pleaded guilty to speeding behind a stranger, and as far as i know

he should in crown court be taking notice of a barrister not a solicitor who has no jurisdiction, who is there only to act as the barristers "clerk"

(no shit) I knew a bloke that hit a pedestrian in 1992 on the A5 Dual carriageway through Milton Keynes and killed him. OK he was speeding doing about 90MPH and it was at 2am. But he got a 2 year sentence for death by dangerous driving? FFS it was a dual carriageway no pedestrian should be walking there anyway. Apparently it was a short cut and he always used it. Nether the less this bloke got 2 years. Not the same, but an injustice all the same?

 

I can only say that in this case that encouraging someone to race you is an obvious offence and should your (opponent) get killed you will be held responcible. :confused:

As i posted before he pleaded guilty because there was 2 witneses to say they were both driving "fast" with the fiesta in front and the 200sx behind and when the police worked out his average speed it was approx 90 mph so with the facts that he was speeding, he was following a car at speed, call it racing?? i dont because if he;d been racing surely he would have overtook the car or tried buy he never did?? but the judge classed it as street racing hence why his legal team adviced him to plead guilty to get a "slap" on the wrist which he didnt.

The very sad thing to come out of this is if i'm driving quick and i see an accident i will always be wary about stopping now just in case which is very sad indeed!!

Spot on mate. I think the fookin law is an ass. You hit the nail on the head saying that about stopping at the scene. How many times have I give it the large away from the lights in what ever I am driving even my works van? Each time I did it was I inciting a race and if the other vehicle had hit a lamp post or pedestrian was I the guilty party????

It’s a bit like the traffic light camera nonsense, in the past almost everyone would creep through a red light to let an emergency vehicle through, but the RAC is now saying not to, as if a camera nabs you, you have no defence and will face the consequences, even if it can clearly be seen that an emergency vehicle was passing and even if you get a written statement from said emergency services.

 

Personally I’d still let a fire engine or ambulance through as in my opinion they are very likely to be able to save a life with those extra few seconds, but copper can wait (as in most cases they are ‘after the event’ merchants, and as likely to be late for lunch, or speed testing their new toy), not had to put it to the test yet, but I’ve seen many a police car siren blaring sitting behind stationary traffic at a red light in the west end.

I dont think the full info is available here, from what is seen then yes it is a travesty.

How many times when racing does the following car close the distance to aggro the car in front at high speed into making a mistake or to hurry the car along...happens a lot.If that has been said as to whats happened then you can see him contributing to the accident.

I remember when I had the option of being nicked yet again for speeding on my motorbike, or attending the Kent Police better riding course (had to bring some mates and it was very informative, still use tricks learnt there today), being told by the police that when pursuing someone, they keep pushing the car in front until the driver makes a mistake. Funny how in today’s PC world, the police statement is always, (words to the effect) at that moment we lost sight of the car, then discovered that it had crashed. Maybe if the lad had said yes I have been behind the car, but at the time of him crashing I had lost sight of it and therefore was not racing/pursuing it.

What if the poilce car you are happily blocking away was on its way to your house to investigate reports of an armed intruder?
