My zed was impounded today after being stopped by the Police! After checking the car and finding NO faults, they proceeded to run checks on me! During there checks, it came back over the radio that i have an expired PROVISIONAL driving licence with 29 points!!!!!! I know for a fact that i have a FULL CLEAN driving licence as i passed my test in the Army and have never received any points at all! I now have to pay £105 for the cost of the recovery and £12 per day for storage to get my car back!

 

How can DVLA be so f*ckin incompetent???? Is there any legal action i can take against them?

Consult a solicitor, do not pay the money, and make them apologise and deliver the car back by transporter.

Your going to have to pay the cost's, but there is obviousley a case there, may it be a clerical error or sometrhing, but there is a mistake somewhere which caused this, therefore its got to be worth persuing.

Problem i've got is, the impound yard is closed till monday, so i can't get my car back! I don't trust them with my Zed!

If you dont pay now, all that will happen is the bill will mount up, and you'll be without your car. You may as well pay it now, then claim it back later. Also remember, any damaged caused whilst in there care, can be claimed for!!

I'm definately paying the charges, if i don't collect the car in 14 days, they scrap it or sell it! But as p*ssed off as i was, it was funny watching the guy take 40 minutes to get it on the tow truck! In the very heavy rain!!!!

Do'nt want to worry you but was'nt there a member on here who's car went to an impound lot and when he went to collect it they told him it had been crushed, but it was suspected that it was sold on??? But I do'nt think that happened over a weekend though bud so sue the hell out of them.

Do you have a common name? I assume you are fully insured etc...? My understanding is they can seize uninsured vehicles, nothing to do with driving licence.

then goto station of officer who logged the offence, under the data act you are entitled to copies of all the note books that they wrote in, copies of transcripts of the radio calls and conversations. your solicitor can also ask for this.

 

get a solicitor to speak to the dvla and get written conformation of your driving status, then forward this to the superintendant of that station and the area officer. Also you have to understand that the police only acted on information given by the dvla, so your case would only rest with the dvla and not the police. However the police can also be made aware of your status and therefore avoid problems in future.

 

Your solicitor can then request your details if incorrect are amended and can also then put in for costs. however.. dont hold your breath on getting them back.

the law states very clearly about this. if they make a mistake they are responcible. so dont pay a bloody penny.

They pulled me initially as a 'routine stop'!!! They were pulling people up all over the place! Calling my solicitor first thing Monday! They aren't getting away with this one!

My wife is a solicitor and here advice is DON'T DO ANYTHING until you've spoken to your solicitor...

exactly - if you haven't got a licence, you haven't got insurance!

 

Speak to your solicitor asap dude - i would imagine you could claim the costs of a hire car if there's any delay in getting your car back. And don't forget, get the piund to record EVERY SINGLE piece of damage - they should have recorded any damaged there in the first place, which they probably didn't.

 

You want to bump up your claim as much as possible, so they can negotiate it down and make an offer to settle ;) (assuming you're telling the full story :x: ;))

Normally you would have found yourself arrested for disqualified driving and your car would have been left at the roadside. That would still have been a mistake but at least your car would not be locked up in a pound.

What a bunch of A_S_holes....complain and sue.....can only impound if no insurance....I feel for ya m8!!!....hope you get it sorted soon and the Zed comes back ok!!
