Can anyone please tell me, can you still be fined if your vehicles wheels are not on a box junction,but part of the body of the vehicle is just over hanging.

Just recived a penalty notice date of offence 13/01/2006 date of notice 03/02/06.

The thing is i was driving a lorry at the time with a folklift on the back, they have put the registration of the folk lift on the notice.

The lorry has a different registration to the folklift because i can drive the folklift on the road it has its own tax but at the time it was attached to the lorry and all the wheels were off the ground do i pay or challenge?

All because of people cutting in on you and putting you in that situation :mad:

the folk lift is 2 tonne BUT it was not on the ground and i was moving about 1mph at the time.

OH my spelling :xxx: i mean forklift

My understanding is this, if any part of your vehicle is in the area you commit the offence and I would assume that since the forklift is attached to the lorry it is part of your vehicle. If the exit is not clear you should not enter the box. HTH.

The thing is...if the vehicle that is charged is actually the one on the truck, you could argue that you were not driving that vehicle at the time...it is a technicality...but a bloody good one...lol

Good point Angus Glover i was not driving that vehicle at the time so ill use that as my defence.
