After seeing all the various TDi posts, it strikes me that Craig & Nico are getting a hell of a lot of grief over comments made by other people.

 

From a combination of various data protection comments & particularly Nathan from TDi's post, it seem that "the administrators" are being held responsible because TDi don't know IP addresses and therefore can't get in touch with people who they're unhappy with.

 

With the amount of work that goes on keeping this forum running, I frankly think it's crap that these two should take all the heat.

 

Craig & Nico, I know you've said you won't but I am very happy for you to quote my IP address if it's specifically requested by TDi in relation to this dispute and if they then contact me I am happy to deal direct.

 

I would encourage others to do the same and take the heat off these guys.

I must say I find the situation of the forum owners being sued for other peoples' actions rather strange, but i guess that is the state of the law as it stands.

 

Lets not forget it was a certain non regular member who kicked all this off.

 

Personally I say if everyone abides with the T&Cs and the new legal guidelines we should not have any more problems - hopfully.

 

Big respect to Craig and Nico they have sorted it once again.

I agree your 'big respect' comment but my reading of Nathan's post is that the situation has not gone away - Nathan suggests they ring him.

 

That was why I suggested people add to this thread to give their agreement to IP addresses being given out. The law sucks but we're stuck with it and I personally consider that if Craig & Nico are getting hassle for anything I say then I should take the grief and not them.

 

I feel really strongly about this so PLEASE TELL CRAIG & NICO THAT YOU DON'T OBJECT TO IP ADDRESSES BEING GIVEN.

 

If you don't do this then to me you are saying that you're happy for these guys to take hassle / threats of legal action on your behalf (either in relation to this current issue or any other).

 

Time for me to take a lie down - I'm getting all emotional.

I do have to question your point of releasing ip addresses though surely the majority of members access the site from a dynamic ip? and this would then take serious cooperation from ISPs to release the callers' details?

 

But to support your campaign I don't mind my IP being displayed.

If TDI have an issue with my they can gladly contact me by my email and ill happily respond to whatever they feel is the correct line of action they want to take.

This issue with them i just have to say is probably the dumbest thing i have ever seen In all my life reading the Info on the internet. And thee is alot of shit on the net as we can all testify but this takes the cake.

You can sat what you like about anyone - as long as you can back it up when it goes to court. Bottom line - Have the proof before you say anything, then they can cry as much as they want.

many thanks for the offer, and the vote of confidence. You have hit the nail on the head here.

 

The information we would need to supply in any dispute like this, whether at discretion, or at legal instruction, is the IP addresses of the people that posted on the thread in question.

 

Now i know that is considered personal information and is protected under the DPA, so unless i have your permission, i have to wait until i have legal obligation to provide it.

 

For those that posted the remarks, do not be under the impression that i am defending your right to post by not giving the information, i am only doing it to protect myself under law. No other reason.

 

The fact that you can post things here anonymously, even threaten me not to give information about you away, and then leave me between a rock and hard place legally, is not a nice situation to be in.

 

Especially when, after i asked for proof, noone comes forward to offer it.

A very nice post, Me and craig are most appreciative of your words.

 

Whether people posting there IP's or whatever will do any good is not of importance at the momment - Craig or myself would not implicate ourselves or anyone else by divuldging that information no matter what, untill we were legally required to do so.

 

What genuinly disapoints me is the fact that no one on that thread, with the exception of Warren (300z, The therapy must be working mate ) has tried to defend their post on the forum, produce evidence of what happend or even contacted TDI, Myself or Craig with even a story of what happened. let alone proof. I appreciate some people were only havin a laff on that thread with the insults that were made and that - but claiming to have had a problem with a business when you didn't is not only wrong, is is Liabel !

 

Dont think i dont understand why somethings that were said were - however in retorspect i hope people will see that not only did they endager this site but they could have potentially got the person or persons they were siding with in serious legal trouble also !

 

 

You guyz may have not known it when the post was made as we didn't but the admin of this place are legally responsbile - the way the law stands at the minute, for the posts that you make - If people carry on with this childish attitude and not play by the rules then the site will have to be closed !

I have never used my ID on here without that address and I would hope that if anyone has a problem with me personally then they know how to contact me!!!

 

As for IP, NO I would not like it given out without my persmission under any circumstances and as you point out, if at such a point you are legally approached to do so then you can contact me and I will instruct my solicitor to deal with the request in the appropriate manner.

what you say is very true, and exactly the procedure i would follow.

 

I had always hoped that if people had a problem with something on the forum, they would approach the people directly, but that isn't the way everyone works unfortunately.

 

just seems that everyone needed a pointer on the things they can and cannot legally say, as it was getting out of hand.

 

saying it is one thing, being able (or willing) to prove it is quite another
