Legal Advice Please!

Basically my car was broken into in a carpark where I have to pay to use. I though that they paid the damage because they gave me a claim form for them, once I sign it I never see it again, so what was the point of that I never know.

They have now told me that I have to pay for it. I did find a sign saying that they are not responsible for the damage unless there is any niglect by them.

At the time of my car being broken into the Security Gaurd was in his hut. Also there 2 cameras in the carpark but one points at the hut and the other one points at about 10 car parking spaces, next to the hut.

Could I claim of them saying that the gaurd Niglicted his duties and the cameras are a neglect of resources. They know that the twats always get in by taking a piece of the fence off, but they dont point one of the cameras up that end.

Also the gaurd said he heard the fence bang and he walked straight up there and he saw they run off out the car park through the fence. It takes 20 seconds to walk to the top of the car park,so in that 20-30 seconds, the twats took a fence panel off, walked 50 yards to my car broke the lock, saw him coming ran 50 years to the hole in the fence and ran off.

I dont think so, I think that he didnt know about it until hours after. When I asked him what time did it happen he said he didnt know.

 

Any way. There is the story, do you guys and gals think I have a case? I hope so cos the damage is over £300 worth. frown.gif

Like our place, loadsa cars been done over in the works car park in the past few months. One person asked security if they had the footage of their car being done over...turns out the cameras are dummies...FFS! mad.gif

Sorry to hear you bad luck Stuart, however if you are fully comp most policies will not effect your no claims or excess if it is deemed attemted theft or break in, your own ins comp should pay up with out penalising you.Had this happen to me in a car park on a previous car, had to get a couple of quotes and that was it,repair cost covered in total and paid direct to garage no penalty or any thing.Hope this works for you.

 

Ps At the car park in question there is a legal requirement for the cctv signs to display the contact name and number of the data administrator and they are legally bound to show you any tapes of you or your property been attacked,if they have not this on the signs they are contravening The Data Protection act,might be way of twisting their arm
