Ok just out of curiosity what is the time frame of getting caught on a speed camera and them contacting you about it?

 

Boyfriend was caught beginning of may but only recieved a letter today about it. We was told by a few people that its suppose to be within 14-28 days after the offence happened

The letter is dated 22 june and the offence took place beginning of may, does this mean that because its been over 6 weeks that it is no longer valid?

It's a bit more complicated if it's a hire car or company car, for example, but around 17 days is right otherwise.

My dad's a retired copper and they can prosecute any length of time after the offence, BUT they must notify you within 14 days of their intention to do so ny issuing a NIP (Notice of Intended Prosecution). There is an allowance for mail delays, the three days above, and allowances are made for difficulty in finding you - e.g. you moved house but didn't change details with DVLA etc

You can argue you have no idea who was driving the car, but you have to give the names of the people that had used the car in that time. You also have to give proof that they are insured to drive the car.

 

If you say there where 4 people using the car around that time, and none of you know who it was that was driving, it would be difficult fort them to proove it in court. Unless they have a photo of you.

It makes us laugh aswell cos he was only 5mph over the limit

A rep once told me that when he got caught, he would say that his mate from America was driving at the time (false name given) and had since returned home. This makes sense as you HAVE to provide them with the name of the person who was driving at the time and if he lived over there I doubt they would get Interpol on the case for a poxy speeding ticket.

 

My mate's father was fighting in Iraq last year. A notice of intended prosecution dropped through his letterbox for a speeding offense which he'd committed just before he went away. When my mate phoned the nick on his behalf they just dropped the whole thing. :shock:

I can vouch (spelling?) for that, my wifes sister works on the cruise ships and she got caught while she was back here, when told she wasnt in the country they dropped the charge too.

his advice is to write a polite letter informing them of the facts, and respectfully request they retract the NIP.

 

If you have a look on the website linked near the top there's some good advice, and if you're in the RAC they'll probably be kind enough to give you a draft letter.

 

The usual problem is there's a backlog of data, but no real managment of it... problem being a high proportion of people would just accept the ticket, so it's not in the Police's interest to keep an eye on the 14 day rule (targets an all!)

If you fail to give any info on who was driving the car, the registered owner of the car will get the fine/points/conviction FACT!!

There is no way round this and people giving false info trying to get people off does not help that person in any way.

Several guys at my work who I know well have got of NIPs (one three times).

 

I've seen the guidelines from Derbyshire Police saying if it's a communal car and the registered keeper has made every attempt to identify who was driving it but was unsuccessful, they won't take it to court.

 

You gotta have some bottle to risk going to court and having to lie though!

 

And I think a NIP from a fixed camera has to be posted within 14 days, from other sources it's much, much longer.

I've had this with company car drivers at work. We own the cars and are the registered keeper on the V5.

 

I have had at least 3 this year where the NIP is actually dated more than 2 weeks after the offence let alone the extra 3 days grace for postage delays.

 

Each time I've written to Thames Valley Piglet as a director of the company, politely pointing this out (although I still gave the drivers' names as required by law) and respectfully asking that the NIP be cancelled.

 

So far 100% success rate.....

I think that NIP's make good cars. I often NIP round the corner shop to get some fags. It can get a bit NIPpy during the winter. If you want to stop something you can NIP it in the bud?

 

On a serious note. The law is the law and they will do what ever they want when ever they want regardless if its TOO late or not. You can't beat the system. :(
