Every home should have one.... right I got the web cam, now how do i set it up to email if im being burgled

Where do we stand at the moment regarding the law if someone breaks into our houses? As far as I understand if i catch a chav in my house i am NOT within my rights to restrain them, give them the kicking they deserve or lock them in the house while i call the police. I also know that unless he is speeding away from my house the police couldn't care less. Not entirely sure if i'm right here, does anyone else know what the current law is?

The crim has more rights that the householder? how does that work?

 

I reakon I could make more money as a burgular than as IT Support, AND I could get compensation if a householder attacked me whilst I was robbing them.... and I could choose my own hours, and choose where I worked.

 

Also, as a burgular I wouldnt need concern myself with IR35, introduced by that other bunch of legalised robbers "Tony Share (my wealth) and his bunch of merry boys an girls"

I think its kinda blown out of proportion (by the tabloids), if you gave a burglar a bit of a kicking and sat on him till the old bill arrived I really dont think any eyebrows would be raised, however it you cane the sh1te out of him with a plank until he is bleeding from the ears and in a coma (or gut them with a kitchen knife) they may not see that as "reasonable" force.... :D

Yes there is a lot of tabloid crap talked about this. The law is not biased in favour of burglars. The number of actual prosecutions of people who have used force against an intruder is less than 15 over the past 10 years or so. No, you do not need to be threatened first.

 

The law states you can use "reasonable force" and it is the jury (or magistrate) who decides what is reasonable. The current guidelines from the CPS state

'Reasonable Force'

A person may use such force as is reasonable in the circumstances for the purposes of:

 

self-defence; or

defence of another; or

defence of property; or

prevention of crime; or

lawful arrest.

In assessing the reasonableness of the force used, prosecutors should ask two questions:

 

was the use of force justified in the circumstances, i.e. was there a need for any force at all? and

was the force used excessive in the circumstances?

The courts have indicated that both questions are to answered on the basis of the facts as the accused honestly believed them to be

 

So you can lock up an intruder to hold him until the fuzz arrive. And you can belt them with whatever comes to hand if you honestly believe you are in danger.

 

And

You are not expected to make fine judgements over the level of force you use in the heat of the moment as long as you only do what you instinctively believe is right at the time. This may still include using something as a weapon.

 

As a general rule, the more extreme the circumstances and the fear felt, the more force you can lawfully use in self-defence.

IMHO Billynomates is right, if i caught someone stealing from my property to feed a drug habbit i would go mad. I work damn hard for my money and i'm sure every one of you on here does too. Does throwing them out of the 2nd floor (lof conversion) window count as self defence or defence of property? Cos watchin them hang on to the gutter for their life would be very amusing while you're waiting for the 5-0 to arrive (and possible the fire service)

And yes I accept there is a lot of crap going around and would seem I might not have got my facts quite straight about the law protecting the bad guys, I spose it just seems that way

according to a report i was reading, just about anything is acceptable as long as its not a revenge attack, you carry on beating them when they are incapacitated & your not allowed to set traps

I reckon u need to give them the opportunity to leave. If they don't, you can then use resonable force, and a weapon if they have one or u need to.

The term reasonable force is viewed differently from force to force which is a little worying, however!

 

Essex's take on it is officialy, if they are in your home uninvited and there for the purpose of an anlawfull act then the owner/ocupier of that home or dwelling is entitled to use enough force to overcome the intruder. In the majority of cases prosecution will not take place as long as continued force is exerted after the intruder has been subdued. If during the struggle the intruder sustains serious harm including death no charge will be brought unless evidence shows force was used after.. so basicaly once they are out for the count, no more hitting or that now murder.

The owner occupier is entitled to use anything at hand to defend theirselves other than illegal items such as unregistered firearms.

 

Yes a baseball bat is ok, yes a knife is ok, yes a shotgun is ok (as long as you can prove they had a weapon)-- argument here is if you have a shotgun and you communicate to them clearly your intention then that ok. shoot 1st question later and your fooked, unless they are armed in which case blast the fooker away.

oh one thing thats non leathal and illegal are tazers and stun guns ffs. but i do understand why they are illegal, if we can have them so can the scum and the scum will use them 1st, same with firearms...

 

IMO there is absolutly no reason for anyone in this country to have anything other than a shotgun otehr than armed forces, too many rambos with small dicks about.

Nelson - I have one of those massive (28") maglite torches, its pretty good for beating / battering / defending stuff. Great for lighting things up too ;)

I've got one of these. Just needs power and it can go anywhere in the house and links into your wireless network. It has full motion detection and e-mail software. In addition, you can log into it over the internet and view a live video stream.

Yeah we use those camera's at work, they are really good. The range on them is awesome, you may as well put it INSIDE your zed, because it would work just as well (providing it is on your drive or in the garage!!)
