Hoping someone has some good advice!

 

Here goes:

 

I was out on Sat night for a few beers and headed home around 2:30 am. I woke up at around Noon with a text from one of my mates asking why my 300ZX was sitting down from her road, as you would probably think this is a wind up. So i looked in my drive way and the car was not there, nightmare! So i got one of my mates to run me to my car, once i was there it was my car and i had a look around and there was no damage and nothing was stolen. So i thought it was one of my mates having a laugh even though it's not funny, as many of them know i usually keep the key in the car.

 

Next the police turn up at my door 11pm last night and charged me with failing to stop for bllue lights and speeding, which happened approx 3:50am!. I didn't know what to do so when they asked me " If there anything you want to say" i said no. I will try and get a solicitor today.

 

The police even put a statement on the local radio to see if there was any witnesses.

 

Really worried as my job depends on me having a licence.

If you didnt report it stolen the fuzz will of course automatically think it was you, however as they didnt nick you at the scene they cant actually prove you were driving so Im thinking the worse they could do you for is not providing info on who was driving the car (max 6 points and a heafty fine, I have one of these 3 points and £300, nightmare for insurace)

 

I'm sure your solicitor will sort you out. cant really see how they can pin it on you but for gods sake lock the fecking thing and take your keys indoors!!

Damn, that sounds like a complete and utter nightmare mate. I can't offer you any legal advice unfortunately. I guess the best thing to do is to get to your solicitor and see where you stand.

 

Yes .. locking your car is always a good idea.

I live in Shetland you see, things like this never ever happens, it's not uncommon up here to leave your key in the car, learn't that lesson the hard way now though!!

 

I never reported it as i thought it was one of my mates winding me up and there was no damage and nothing was stolen.

 

This is a total nightmare!

if its the norm up there to leave the keys in the car (sounds like a nice place!!!) then the police must be aware of it, I still think you are looking at (checks license) an MS90 "Failure to give information as to identity of driver" was actually only a £145 fine I got.

 

get that solictor pronto though! and good luck! (dont let the buggers grind you down!) :)

what time did they file the report as to your speeding away?

 

do you have witnesses to say you were in a pub/club at that time?

i can't honestly see the police taking it much further, although you say they turned up at your house and charged you?? do you mean they took you to a police station and charged you?? or did they caution you?

No they came to my house and charged me.

they can not prove without reasonable doubt that you drove the car that night

dont let them pressure you , i have first hand experience of the police in the shetlands

they are usually ok ( i worked at Sullom Voe 1981 ) lived in toft camp they will notspend the money on investigations on a dead loser like this they are trying to intimidate you into accepting the fact , call their bluff you are in a win win situation

i know lots of folks on Scilly leave their keys in motors as well so it must happen from time to time

What's the worst thing that could happen if some how they manage to pin it on me?

1. Driving at excessive speeds - or something like that.

It's the registered keepers responsibility to know who is driving the car at any given time so if you dont know who was driving its still your fault :(

who THEN YES you are liable for prosecution, to say you must always be aware of who is driving your car throws up to many ifs and buts, ie your on holiday and someone in the house uses the car, someone takes your keys at work, or someone takes the car at night etc etc

 

one thing i find strange and hard to understand, is that he said they came to his house to charge him???

to charge someone with an offence, you have to be interviewed under caution and recorded, and then a custody sgt' has to decide the next course of action and whether there is enough to continue, we would be right in the shite if the bobby on the beat had the final say how to proceed, hence why pace was set up????

true about the charging bit, been there done that a few times!! :nono: maybe it's the informal shetland thing.. seems to be a magic land stuck in a bit of a time warp where the kids are free to roam the streets without fear of being abducted and people leave thier doors unlocked!! :D are houses expensive there???

There's no squatters rights in Scotland. If someone is on your property they can be done for burglary/breaking & entering. Scotland has got some good laws.

The text you recieved will be date and timed, and also your mates will need to give evidence they had to pick you up, to take you to your car. Also how did you get home??? Did anyone see you take a cab, or walk home???

 

You need to build eveidence that it wasnt you driving, also why would you park your car away from your home???

As there are approx 1hr 20 mins from you heading home, either on foot, taxi or other means till the time of the offence, and you cant prove where you were, then unfortunately its bad news !!!

 

Its the judges call, and as its a sports car with, I presume a young (ish) person driving, (allegedly), he has to decide whether you are guilty or innocent of the offence.

He has proof that your car was caught on camera committing an offence at a set day & time, if you cant prove to him that you were not the driver, then i`m afraid its points time !! Facts are what they go by and if you dont have an alternative to their facts, then the games a bogey !!! :(

 

Hope you can track down the taxi driver or summat mate.
