My god. Traffic police actually still do exits. They all havent been replaced by cameras.

It's been years since I got followed by a traffic cop - used to happen all the time.

Now I only see them when they've stopped off for a nap on those motorway form filling ramps.

I hate cameras but at least we all know where they are :D

 

I think the next scam will be to arrest everyone with a knife in their kitchen because they could have an accident and hurt someone.

Should be a great money maker :D

what i would do is to document everything you and the plod have done.....and make sure in your plea of mitigation which you send to the court that at all times you have complied with and tried to pay this all along and havent contested it and in no way wanted to waste the courts time....make sure you send this special delivery so you have proof of doing so and in doing so you should only receive what you were originally going to receive and not have to pay court costs or extra due to plod cocking up and not you....you have already admitted guilt and now trying to get out on a technical point will only cost you ......twice i have done this once on appeal and once on sentencing and on both occasions it was instrumental in me being dealt with most leaniently

All sorted. Thanks Tooley I had the whole Police Station conversation on tape and the witness statement copied etc. It appears that legally I have grounds on this and not the ticket. In other words duff info from local Police. The worst is 3 points and £60 the best nothing! The fight goes on....... the solicitor is free!:)

Isn't the ticket just in duplicate? Why would the police copy be any different to the one handed over?

Like I said, and has already been confirmed..cant contest ticket on omission alone..can contest the evidence though,, you will be provided advanced disclosure if you have to go to court..your brief will sort this out

As advised before, and I believe this was confirmed, the advice in the police station was incorrect so at the worst it would be dealt with as a fixed penalty.

Thyere is another way..phone then write to their central ticket office, point out the facts, were you asked to produce insurance too, therefore you could'nt and should have been reported for no insurance when you went to hand your licence over. likewise for MOT..depends if the police asked for it,

this should be referred to the issuing officer who may agree to retract out of embarrasment, if not you are going to be summoned to court. It is possible that by writing a clear factual letter (not sarcastic or no chance) you might be able to slide out of it...of course, if your speed was too excessive then....mmm.

If you do get summonsed you can rely on the fact that the police failed to take your licence when you went to surrender it (if you intend to plead guilty) and this should be dealt with as a penalty (3 points £60 but you would still have to pay CPS costs I'm afraid)..mention this in your correspondence to the police...

Or you could plead not guilty and contest the police evidence, you will be sent this prior to the court date and are entitled to it under the rules of disclosure, you CANNOT rely on the omission of your reg number on the fixed penalty as the omission may have been realised and written down shortly after,,i.e when the original notes were prepared either at the time or soon after...A lot depends on what device was used, Vascar...not a hope of getting off if it was calibrated correctly, Police pilot..same and usually video evidence to support it, speedo..same again, calibration issues, laser, never known anyone throw doubt on this device as it is so accurate and instant, hand held radar (the little blach 'hairdryer things' now thats another matter, totally inadequate.

Last person I stopped speeding was pissed as you like, never know your luck, might catch another one tomorrow...or is that socially acceptable?...

i dont think speeding itself is that bad its dangerous driving. i think if you were to go 100 on and empty straight long road its fine its when u drive fast in town villages or in traffic.
