It appears that we have a few legal type minds here, so any help/useful comments much appreciated with my dog problem.

 

I was walking my 9 year old German Shepherd on a short leash when a kid who knew my dog came up to us an started stroking him. No problems there, although I did ask the kid not to touch my dog that day because my dog was unwell. My dog likes kids.

 

There was another group of kids about 50m away, that I always keep away from because amongst other thing they bully my 9 year old son, and I don't want to get into trouble for telling them what I think of them. One of them (who has never met me or my dog before) comes over towards us, and completely ignores two requests to go away and leave my dog alone because he is unwell. Kid then starts patting my dog on the face, amongst other things catching his eye. Still no reaction from my dog. I again tell kid to go away but no reaction. Kid pats dog on face again then steps back half a a pace directly in front of the dogs's face and starts staring at him. I've had enough at this point and am about to limp off (recovering from gout) when kid tries to touch my dog on the face again and gets nipped on her lip by my dog. She goes to the same school as my son who has seen that the the injury is really no more that a swollen lip.

 

Don't get me wrong, my dog should not have nipped the kid, and I am gutted as much for the kid as much for my myself and my dog, but he does not deserve to be destroyed for a defensive action that I did my best to avert. She was told to go away three times because the dog was unwell that day. He did not aggressively attack anyone, and has in fact since been accessed by the UK's leading dog behaviour expert as a social, non dangerous dog.

 

Since the incident the kid's uncle has tried to kick down my front door, threatened to kill me and to harm my son. The only witness to this was my wife. Would I be abl to get a court order banning him from some distance from both my home and my son's school?

I think the video camera is a good idea. But you need to inform the police of the whole situation so that if something does happen (touch wood it doesn't). Then they will have a prime suspect.

 

Any damage to the front door ?. If so, then let them know about that as well and claim from him for it !.

Sod's law applies here. He was about to hit me when I showed him our camera (installed after our cars were paint strippered a few years ago). Got indoors to find out the the video had eaten the tape as it started. It never rains but it pours :cry:

I'm sorry if any grown man ever threatened to hurt my 10yr old son, I'd cut his f**kin lungs out. :mad: or at least gather a group of select friends and .... we'll leave it to ur imagination...

 

legal oh yer, you and your wife count as two witnesses. Report him to the police. Get the complaint in.

 

Get a discreet door camera linked up to your Video recorder. They are pennies these days - http://www.maplins.co.uk. any hassle at your door fire up the recorder.

 

Theres even a kit for around £60 thats infrared (nightvision) for up to 5m

but as smw1 says if that course is not an option, then protect yourself and your family within the law, but some muppets take that as a red rag to a bull

 

personnaly if you don't want to get involved in confrontation, id buy an old scrapper darken the windows and run the chicken shit over, as he's leaving a

sorry your original question m8, if your worried about the dog etc report them first for teasing the dog etc, not for a visit, but just so you've got it on record;)

All well and good if you really want your dog to be PUT DOWN! Go the law-abiding, record keeping/video way in this instance! If you take it out on the asshole who is threatening you then the police/court will see YOU as a 'hooligan' with a savage hound!

Sorry to hear about your situation, hopefully this will put you mind at ease somewhat and provide some food for thought.

 

 

With regard to your concerns about your dog being destroyed. Section 2 of the Dogs Act 1871 applies to dangerous dogs which are not kept under control, for which an order can be granted for the dog to be destroyed. However, under case law (basically previous court decisions) it has been held that a single bite, under provocation, does not make a dog a 'dangerous dog'. So, if your description of events is accurate, the bite would not be criminal. But, be careful with your dog in the near future, maybe take a drive in the car and take it walk somewhere different, or at the very least change your normal route.

 

 

Secondly, with regard to the attack and threats made at your house, it is correct that two eye witnesses are enough for the police to charge and report the kid's uncle. You should report it to the police. If there is not enough evidence to proceed it should still be reported, as if anything similar happens again this could be regarded as a 'code of conduct' for which he could either be charged or an application could be made for a interdict under the Protection from Harassment Act 1997. This could include banning him from certain places or contact with certain persons, I.e. your family members.

 

I would report it to the police, the police involvement alone may be enough to warn him off, and if it does not, talk to the police about a Protection from Harassment order.

As above mate, get the police involved. Hopefully this should scare him off. If not then the protection from ahrrassment order is next in line. Then if this doesnt work and he still bothers you then obviously you could get him done for breaching the harrasment thing but take it further.

 

Id mention what has happened to the police. Then next time he comes round turn the video camera on and try and be reasonable again but get it all on film. If he tries to hit you its on and you will have it on video.

 

A fully grown fella threatening you and your son. Especially your son! Priks like this really piss me off. Any reasonable person would have knocked on the door and found out what happened. Does he know the whole story or just his neices side of it?

Get witnesses and go down the police station tomorrow, also a video will help with a restraining order,

 

if he has kicked your door then that is criminal damage, if he has threatened to kill you or your children and then kicked your door then that can be classed as "Intent to kill" and carries a 15 year sentance.

Thanks for the support guys. I'm just praying that all goes well. The dog was actually a present to my wife 9 years ago and she is absolutely devoted to him. I'm afraid that the loss of the dog would tip her over the edge when added to all the stresses since her father died at the end of last year.

Cant you let the dog stay somewhere, relatives/friends while this is going on, and if it comes to the dog being put down refuse to hand him/her over. There's no way I'd let someone put my dog down.

agreed - protect the dog at all costs. the fact the dog only nipped that girl shows it's a nice dog, as it had every reason to bite her. no way can they get to it if it's at a friend's house - if I lived near I'd help you.

slightly off tangent but even when hopefully the criminal side of this has been sorted you may receive a letter from Solicitors pursuing a claim for damages on behalf of the child. the fact the injuries are only minor won't be a barrier to this as for claims on behalf of children, even if damages are only negligable, the solicitors costs etc can be recovered so someone out there, depending on what story they are told, may look to take the claim on.

 

the claim would initially be sought against yourself but your home insurance policy should hopefully provide you with cover so it may be worthwile checking. they will not simply settle the claim on your behalf so the more information, particularly in relation to a timeline of events you can give them the better. it may therefore be worthwhile documenting everything you can now whilst everything is fresh in your mind and keeping a diary of everything connected including specific times and dates, police references etc, etc.

Fortunately we have PetPlan insurance. They have paid for the professional opinion on his temprement so hopefully they will sort out any other 3rd party claim issues.
