Bo!!ocks. Got home today and found a police notice on the mat. I'd been caught doing 34 mph in a 30 mph zone (not near any residential areas, empty road etc.), 3 weeks ago! I'm not complaining (much) but i'd always thought i'd get done doing 100 mph +, do not pass go, do not collect £200 style!

Shouldn't they be out fighting proper crimes?

Is it a NIP? IE were you wern't stopped?

 

They have 14 day + abotu 2-3 for postage to get it to you. If not then sod them.

If it a NIP, they've got 14 days to get it to you.

Might be worth telling them to go **** themselves ;)

I may be wrong BUT I'm sure they have to notify you within 14 days. Check this before you get too excited though ;)

this is a letter that someone off SXOC wrote back after recieving a similar NIP.

 

"Dear Sir/Madam,

 

I am writing to inform you that the NIP received through the post this morning did not, as according to Road Traffic Offenders Act 1988 arrive within 14 days of the alleged offence, please see an excerpt from the act below..

 

Road Traffic Offenders Act 1988,

 

(1) Subject to section 2 of this Act, where a person is prosecuted for an offence to which this section applies, he is not to be convicted unless—

(a) he was warned at the time the offence was committed that the question of prosecuting him for some one or other of the offences to which this section applies would be taken into consideration, or

 

(b) within fourteen days of the commission of the offence a summons (or, in Scotland, a complaint) for the offence was served on him, or

 

 

© within fourteen days of the commission of the offence a notice of the intended prosecution specifying the nature of the alleged offence and the time and place where it is alleged to have been committed, was—

(i) in the case of an offence under section 28 or 29 of the [1988 c. 52.] Road Traffic Act 1988 (cycling offences), served on him,

(ii) in the case of any other offence, served on him or on the person, if any, registered as the keeper of the vehicle at the time of the commission of the offence.

yea i thought that but the slimey bar stewards dates the NIP 18/06/03, so i'm goosed (exactly 14 days after i was spotted). Apparently there is a speed awareness course that i can elect to attend which changes the fine to £90 but you get no points. At my age a extra £30 is better than 3 points.

No no - you must RECEIVE the NIP within 14 days, not have them date it on the 14th day.

It's from the date of the offence plus a couple of days to post it.

Otherwise you are deemed too unreliable a witness to the event if it's more than 14 days ago.

 

Cheeky sods, I hate cops sometimes when they spend so much resources trying to catch an upstanding citizen for a very slight slip up :mad:

Ah yes, but you have to prove that you COULD have received it within the 14 days, regardless of postage.

 

Quite clearly Stuey could NOT have received it in that time, as it was written on the verhy last day. :)

Have a look on www.pepipoo.com, choose 'Basic Facts' from the left hand menu and then choose 'The NIP' - this gives some info about written and verbal NIPs.

 

Basically, there was an amendment to the law in 1994 which allows the cozzers to use standard post to issue an NIP, thus they DO get an extra 2-3 days to allow for postage.

As a general rule, I always allow 21 days (overkill, I know).

 

Looks like you're caught. I'd just do the 'speed awareness' thing...

Also, all NIP are supposed to be sent recorded delivery...only the problem is most police forces almost never do - so you *might not have got it yet*...regardless of the post date, if you aint signed the postmans book for it, they dont know its been delivered.

Ay - unfortunately that is NOT a defence you can use. :(

 

There is a whole thing about this, in fact I posted it on here not that long ago and you can't go with the "I didn't recieve" it defence.

Seriously though I know some one who went to a drinking and driving one, he said it didnt change his view on anything.

Ajay, you can go with the, I received it and sent it back...you must have got it...all the while you have filled it out, photocopied it for your records, and burnt the original. When (if) they follow it up, you can ask if they would like to see the copy you kept for your records, and drag it out until its statute barred. Chances are, according to a traffic officer, they will not get round to following it all thru in time to keep it inside the statute barring limit.

and the not signing it is a bit of crap...according to the same officer and he isnt just saying it so no one does it.

On the back of the form it says that contary to media reports if you don't sign it and send it back, they'll do you and also if the van was on double yellow lines etc it doesn't matter, and i quote: 'police vehicles can access and have permission to park and operate in areas that normal vehicles cannot'.

I think i'll just cough up £90 and go get bored for a day.....just wondering if "my car accelerates to quickly" would be a good excuse?;)

30 in a 34 - man that is close called and not really in the spirit of slowing people down is it?:rolleyes:

 

When they have cameras that detect drivers who tailgate and then prosectute those drivers then I will have some respect for them.

I dont get it??? How come police vehicles can park on double yellows and be safe, when if i parked there i would be a hazard and get ticketed? Double standards more like.

Stuey, 34 in a 30 is ok, they wont bother following it up its such a joke. Go with AY3388 and file that NIP in the fire now.

If i have a police car behind me in a 30 i still do 35 and i havnt been stopped yet.

I'd love to get a hold of a speed radar gun and catch all the police cars doing over the limit around here, no lights / no siren, but of course they're 'expert' drivers and we're just fookin idiots.

Regarding the police's right to park anywhere such as double yellows etc....this is not quite true, it does not make sensible logic, as up my street last week a safety van was caught on camera for parking half on the pavement over double yellows and obstructed the flow of two way traffic to one way traffic.

 

The matter was raised by the local paper and the police made a public apology with the excuse that the particular officer was "getting to know the area" and he made an error of judgement concerning his chosen location.

 

The funny thing is that the next day another officer was caught on camera parking similarly on the other side of the city and this was again covered by the local press. This may explain why there are so many uncaught criminals/unsolved crimes.

 

I've heard that people have hung blank cds on trees and other objects by roads where cops often put there safety cameras to screw up their readings. Does this actually work or is someone pulling my leg????? I ask this as I've seen a few cars with blank cds replacing the fury dice.

I thought the CD thing was to screw up cameras which flash - the CD would reflect the flash and the 'flare' would obscure the resulting photo. :confused:

That's why they have so many accidents when attending an alleged crime or chasing joyriders !

No that is total bull. They probably think that but it wont happen.

 

As for police cars parked on pavement to catch people speeding, if you manage to get a photo or prove that the police car was parked illegaly they can not use the photos to prosicute you. They can not brake the law catching people breaking the law. Its double standards.
