Due to the fact that the Estates department of Bangor University failed to carry out it's duties, my car has suffered the consequences!

About 6 months ago, a slate fell of a buiding across from where I work. They cordoned off an area as it was obviously unsafe. Since then, some idiot has removed the cones that were there despite the fact that the roof hasn't been fixed.

 

Of course I wan't aware of this so I parked in a designated parking space as one would. The next thing, the porters are knocking on my door telling me that my car is damaged.

 

The door mirror was ripped off, the passenger side glass is scraped, the wing is damaged & there is a big paint chip on the door.

 

The real fooker is that the University say that you park on the grounds at your own risk!

How crap is that, you go to work & you leave worse off!

 

Does anyone know if I've got a case for claiming against the University?

 

I mean FFS, I could have been getting out of it & the slate would have landed on my head!:(

Wrong...they have a duty of care to you. That sentence is actually not allowed - won't stand up in a court of law.

 

Even if you were trespassing, climbed the roof and then fell because of the dodgy slates, the University would STILL be to blame.

 

I would initially write to them and explain what has happened - you can claim on their insurance.

 

If you get no joy, seek legal help, wither via your insurance or separately.

not related but i was talking to some of the Net/IT boys from Bangor at Gregynog today. :)

You have a valid claim, as they new about the problem.

 

They must have somebody on site responsible for health and safety.

As you say it could have landed on somebodies head!!!

 

Write to them directly with your claim and include the costs of the repair, and point out the history, which you have only just become aware of.

 

They have a duty of care to people and /or third parties using the fascillities.

Should be covered by buildings insurance. Happened to my neighbour too. Their insurers try to make you claim on the car insurance but resist and insist they meet their liabilities

If youve got that legal protection on your insurance, give them a bell and they will sort it for you!!

Hurrah! Insurance have paid out for the damage to my car.

All £822 of it, in advance of repair too! ;) :)
