Any one know much about GTO's ? it's the twin turbo 90 spec.

Mate of mine who unfortunately is very young and naive bought a modded one from Leeds the other day, after handing the CASH over, 15 miles later it loses all transmission ( no clutch) then dumps it's coolant on the hard shoulder, stuck there in the middle of the night he decides you get it trailered back to I.O.M ( against my advice) £400 lighter for said pick up, i get the car inspected by performance engineer, seems it's a minger ! quotes of nearly £3,000 result in tears, so question is does anyone know how hard/easy gearbox removal is, Engine in or out ? Water pump removal the same and as rear rack is fooked, again hard or easy ?

Unfortunately a private sale and seller made an offer that won't even cover costs of trailer :mad: Oh and get this, car was MOT'd on the very day car was sold :eek:

Any ideas or help would be appreaciated.Though i am trying to get him let me bring it back and plonk on sellers driveway....

Irrespective of the MoT issue there is almost certainly a course of action under the Sale Of Goods Act in that goods have to be fit for the purpose for that which they are intended.

Unsurprisingly it is known as 'Fitness for Purpose'...and in the case of a car it means that the car should actually go, unless sold as a non-runner.

 

There are a couple of things that can cloud the issue..like 'Caveat Emptor'....essentially this means that if the buyer has actually inspected the goods then he has LESS recourse than someone who didn'y!!

 

In the case you mention it should be fairly apparent that a cursory visual inspection will NOT reveal major mechanical defects so it should not have (too much?)/any impact.

 

 

Definitely get him to talk to his Citizens Advice Bureau....they will almost certainly het him to initially approach the seller. If that fails to get anything done ( and to be honest anyone who sells a car with that many problems knows what they are doing...so don't hold your breath!) then it should be done through the Small Claims Court.

 

 

Steer clear of solicitors....over £100 per hour and that money is NOT recoverable, pretty soon your costs are more than your claim. With a Small Claims case you pay a fee dependant upon the size of your claim....this money is recoverable if you are succesful.

Yep - so mad I posted twice!!!!

I thought that cars sold privately are "Sold as seen" which means you don't have much if any comeback at all.

 

Buying from a dealer you do have comeback as I know coz me Bro spent just over two years fighting Aidan Piers over a shed of an Alpine!

 

Two and a half years of vast expense on legal fees, barristers fees, storage fees, professional engine builder fees to strip the engine to prove to the court what was wrong with it in the first place and all for the tossers (dealer) to settle out of court a few days before the court date!

 

Trust me, do it if you can stomach it, but believe me it's a long, hard slog most of the time and most of the time you still lose out financially.

 

Best guess on this is that you could do the MOT station for a shat MOT.

Hey Smithy.

I own a '91 300ZX and a Mitsu 3000GTO twin turbo.

I've had the Nissan for 2 years and the only repair I've had was to a vibrating prop shaft. I gets driven hard and seems to be unburstable.

I've had the Mitsubishi about a month and a half and spent 3 times as much already.

I bought it from a a good spud and he told me all the faults it had and most of the money was allowed for.

Never-the-less I know from the GTOUK.org.uk site that the Mitsu is more fragile than the 300ZX.

I find the Mitsu a better drive with the 4 wheel steering, 4 wheel drive and excellent performance but at what cost...?

There is a source link on the GTO site and many guys who are happy to help with advice and parts.

There is - it's called the misrepresentation act and it's more powerful then you think.

 

If your mate has made it clear to the seller at the time of purchase that he intended to drive the car back, then it is implied that the seller has sold the car in a condition fit to drive. The only problem is proving that the seller knew this was not the case, which may be difficult when the seller can say ' it had a new MOT'.

 

I believe the Act came into force to protect house buyers from buying a property next to problem neighbours and the like. On famous con artist was reported to be ordered to pay over £160k to the guy he sold his house to. (It was proven in Court that he had said in writing that he had no problems with any of the neighboursd and it was sunsequently proven that he'd had 12 years of legal battles with both sides!) - {Urban Myth - not to be mistaken for the real facts of course! :D }

Mondo - I think your ZX is knackered if you think the GTO is a better drive!

 

It's a handling disaster compared to a zed - no competition at all

Gearbox can be removed without the engine but VERY VERY hard without a 2 post ramp. I did one about 2 months ago (with a 2 post) and wouldn't do another! Gearbox is fairly simple but tricky if that makes sense , the water pump is a Bitch!!! I do not envy anyone having to do that job with the engine in. Timing belt, Plenum , coil packs etc has to come off to gain access to the hard pipe and water pump. I would say that the water pump is harder than the gearbox but I am sure someone else would say otherwise.

 

Try anything to get the money back and return the car! Try the CAB and even the Police as previously suggested, after all you have nothing else to lose.

 

Autodata talk rubbish when it comes to job times in my experience!!!

Well the latest on this is, car was taken to the MOT Inspecorate who checked it out and found numerous fails with it, they then pusued a prosecution against the garage, however proving the car was in that condition when first MOT'd was the stumbling block.

They commented on the fact the car was advertised in the Auto trader as having been regulary tuned by a certain well known company who supply and now install Jap performance goodies, their company name was in big 8 inch letters on the car, a car being in their garage being tuned all the time would have had the faults spotted and rectified, in the inspecorates opinion ....

So we have found out, the mot garage have had complaints before, the seller was friends with the garage owner, this tuning company had never worked on the car, but still alllowed the advertisement !! Now the biggest stumbling block is we are in the I.O.M and the court case would be in UK, the laywer dealing with this is a family friend, but oh so slow. He reccomends dragging the tuning company to court as well to prove no work done by them, thus discrediting the seller ( a liar)

Numerous offers by the seller to post a cheque by ways of an apology have never materialised.

New clutch done, water pump done and a few of the leaks done, with that and costs involved for towing etc, over 2 1/2 grand spent :( so not good. Got a couple ideas of getting even with the seller, just ned to see if we can work em out.
