Online retailer claims faulty goods not their responsibility.....

Hi, In November 2012 I purchased a Desk charger for a new mobile phone I got my then fiancee for christmas. This was purchased from the biggest online retailer named after a rain forest:whistling:

The item went faulty and I have contacted the website who now say that it was sold by someone else through them and they are not responsible in any way....

On 29th July a representative of the website agreed to email the supplier and would give me a refund for the product if the supplier didn't sort it out.....

Now the website claim they won't abide by the promise made to me the day before and NO refund will be considered...

I have quoted the sale of goods act 1982 and been told that they are not bound by UK law as they are not in the UK, even though they are a .co.uk company....?

The supplier claims to be in the UK, but replied to my emails at 4.34am???

 

I want to make everyone aware that not all .CO.UK companies are required to act under UK law and that certain Large Companies that you would think would protect their customers, don't actually do so....

I was shocked to read all the cop out small print and claims that ANY item purchased on this website has only 30 DAY'S to be returned or there is NO warranty.......

I thought UK had 12 months on electrical items?

I have tried 'be of satisfactory quality' and 'be fit for the purpose' and got nowhere.......

 

I am furious, frustrated and now determined to stop this happening to anyone else....

Trading standards, Watchdog and your credit card company are the only options I can suggest. Total bullshit that they can do this, if you sell in the UK you should be subject to the same laws

Sorry to hear you've got problems, but they are registered in Ireland for the UK trading, which is why they don't pay UK tax!! however as part of the European union they are required to practice cross border trading standards, might want to try citizens advice for a quick pointer.

 

 

Company registration has nothing to do with internet trading addresses.

I can't believe that anything bought through a trader other than the website company only gives you 14 days to report the item as faulty and 30 days to actually return the faulty item.....

I know I won't be ordering anything from them again after the email I got from their 'Executive Customer Relations' representative....

How many of us have ordered from this website under the misapprehension that our consumer rights were protected by the website, whoever the seller is through them...

I thought you paid them, so they are responsible for dealing with any problems with their traders.....

I was shocked at what I have been told, that a buyer has NO rights when buying from this site.....

 

I am going to trading standards and will also be sending them a subject access request under the data protection act for all copies of phone calls they have recorded without informing me they record ALL conversations.......

Grrrrrrrrrr...... sorry ranting again....

Same company was featured on a tv programme the other week, rip off Britain ? Not too sure but anyway....... Woman bought blade less fan off web site, she'd searched for a dyson one, she bought one that came up in search, it was faulty and had a European 2 pin plug, she complained

 

Wasn't dyson

Didn't work

Wrong plug

 

Large company said the same, sold on their website but not by them so ...... Tuff !!

You do need to be very careful (and Amazon aren't the only online shop that does this) and make sure you're buying from either the main site or a trader being hosted on that site. Your rights as a consumer come from the trader you actuallly bought from. If they're in EC, that doesn't let them off - you can get help here http://www.ukecc.net/

If you're one of those people who are concerned about the dominance of particular retailers or the amount of tax they don't pay, one piece of advice I heard and now follow is if the thing I want shows up on Amazon, I see if it's available froma trader, then find that traders's site and buy from them. They get their full margin instead of sharing it with Amazon (whose charges are enormous) plus they probably can't afford massive tax lawyers to get out of paying UK tax.

So they admit telling me they would refund me, but are not going honour that promise as they gave me wrong information?

How can a company offer a refund, then change their mind, surely if you agree to a resolution then that is what you stick to?

Surely they are just like any other retailer that sells other peoples products ? That are liable if you paid them !

Warehousing/distribution etc can be in any part of the world, it is the location of the registered offices of the company that accounts for it's taxation base and therfore offical trading address.
