let me warn you so you dont fall into the same trap as me, when you sell a vehicle do not hesitate to phone your insurance company and tell them you have sold it and to put your insurance on hold, also get a reciept of a signed doc saying you have sold vehicle

 

im currently payiong £1300 a year for my 1.6 focus, i sold the M3 last year, it was a bank holiday weekend and i sold it on the sunday, i had a vehicle to replace the M3 but wasnt getting it till a few days later, i decided to leave the phonecall to the insurance company till i got the new car and swop it over to the new one so i wasnt phoning them twice, big mistake

 

monday night came and i get a knock on the door saying my M3 had been involved in an accident in birmingham at 10pm at night, it was 11pm when the police called and the drive from mine to bgham is around 3-4 hours, explained to the police i had sold it and so forth and they went away and believed me, phoned bgham police and explained to them aswell, all ok, believed i sold it and it wasnt me driving, all was well so i thought

 

i eventually got the car few days after that and phoned insurance company to swop over, it was then i was told that the M3 had been involved in a hit and run with another vehicle, no one seriously injured but the merc it crashed into was a write off with a full car of people claiming wiplash and personel injurys and as i was the only one with insurance on the M3 at the time of the crash it was me the merc drivers insurance was coming after and because of this my insurance went up on the focus from £370 to £1300 as till the claim is settled they suspend your no claims even though they are protected

 

this is still going on now but hopefully it will be sorted soon as my insurance (elephant.co.uk) have said they aint paying, the guy i sold it to told elephant that he sold it immediatly to an unknown party:confused1: and that he wasnt accepting blame either, its been very lengthy and stressfull as the other insurance company has been ringing me for info hoping i slip up, i will get all the money back when its sorted but its still a ballache pulling out over £100 a month for a bloody focus lol

 

apparently bikers leave their insurance running over the winter and sell the bikes to gain another years no claims and this thing always happens to them when the bike is involved in an accident

 

so please beware and take note, although it looks like they wont claim from me its still a pain in the ass, oh and luckily i kept all texts and communication on my phone and its been passed onto police as it sounds very suspicious

.....I hope it all works out for you in the end mate - and it seems like Elephant is doing the right thing by refusing to settle the claim against you. After all, when you insure a car as an individual, the car maybe insured - but only to the drivers named on the policy. And it's clear you were not driving at the time of the accident.... Trouble is, your car is (or was) on the MID as being insured at the time and that policy was in your name....

 

I'm sure common sense will prevail - but it does not stop the aggro etc for you (or help with your current car insurance arrangements) whilst the matter is unresolved.

 

Thanks for the warning; it is certainly a lesson for us all.

no probs mate, my insurance company are doing the right thing, but the mercs insurance is working for them to get their money which ever way they can

 

it is a ballache, but hopefully will get sorted and lesson learned

Blimey, I had never even considered this. I often replace my daily drivers and usually do the same as you. Hope it gets sorted for you.

told a mate my story the other day and they hadnt informed insurance comp that they had sold the car

I had something similar happen to me, when I bought my m3 it came with a plate that was to be returned to the previous owner. Fine no problem apart from I bought the car through a dealer. Anyway paperwork took a while to get sorted but it's hard to say at what point mil2100 was to come of and r647dkx was to go on so I waited for the confirmation to come through which took ages.

 

In the mean time the old owners of their car had just put mil2100 on their new car and promptly been in an accident so I got a snotty letter from my insurance explaining that they would appreciate it if I told them I had had an accident. Of course it's the first I knew about it. The mad thing was my insurance knew from the vehicle description that mil2100 was a merc slk by this time not the m3. So it then came to my renewal yet my insurance was horrific as the claim hadn't yet been settled for a car I didnt own hadnt ever driven or even seen involved in an accident 200 miles away. Eventually (after sending a photo of my car intact!!!) after much messing and negotiation I sorted it out and the quotes came sensible!

 

Long story short be really careful when transferring plates!!

well its still not sorted but been told its been passed to the MIB so hopefully in the next month or so it will be sorted

 

fingers crossed, been a long drawn out affair and to be honest apart from paying over a £100 a month for a focus in insurance it hasnt been any hassle at all, elephant has done a decent job thinking about it

Al, it's good to hear that admiral (elephant) are doing a good job as far as the claim goes. Your premium will probably be high as there will probably be an open claim on your record with them until it gets sorted out at which time they should give you a refund. It might be worth you asking them (service dept) to tell you what the right price will be if the incident wasn't showing. That way you'll know how much you should be paying and what to expect as a refund later as it may be that the record still affects you (that way you'll also know that it hasn't been rated at all).

 

I'd also suggest that once its sorted, you get them to ensure there is nothing showing against you on the CUE database as a lot of companies are checking that now as a standard practice.

 

Let me know if I can help in any way. Obviously it's not admiral I work for but might be able to help on standard practices by an insurer or how the ombudsman might view a case as I work in that sort of area. You know where I am mate

It goes without saying that the bloke who bought the M3 has a lot to answer for... The days of selling a car to an 'anonymous bloke from the pub' are long gone. Everyone has a legal obligation to provide keeper details now, and although he claims he doesn't have them, he is therefore committing an offence and can/will be prosecuted for it. The chain of events with the accident obviously follow on after his 'fictitious' sale, so you should hopefully be firewalled..... If they can't identify the driver of the M3, the Merc's insurance will have to pursue their claim via the MIB. The fact that your policy had not yet been cancelled doesn't make the anonymous driver insured anyway. If it was your 17 year old next door neighbour driving you home from the pub on his provisional licence when this happened, would he be insured then? Stand your ground mate. The worst you are responsible for is tardy-admin, and on that note, let-him-without-sin, and all that!

Dont count on the full amount Stellaz, MIB only pay back a maximum of 2/3 of an uninsured claim. :cursing:

Whenever I sell a car I always write two copies of a receipt, one for them and one for me both parties signing both and both including the date and time of sale. I only do this to protect myself against traffic offences commited by the buyer but now I see its got another benefit

this has been going on a year now and my insurance on the focus is due tomorrow, logged onto admiral (insured with them currently) and noticed they had issued my renewal which was £800 this year down from about £1200 last, quickly rang them and been told the claim was made and no action will be took towards me and that its all sorted and my no claims have been re instated (16 years)

 

asked if they could do better than £800 and they got it to £540 with silly excess, told them i would get back to them, couple of comparison site quotes and got it down to £343 with monthly instalments and £200 excess

 

well chuffed, now to ring the claims dept and get the money back they owe me

its a 51 plate 1.6 focus, nowt flash but i live in a high area of crime apperently and its left on the street

getting a refund of £411 which is good but im after more, when i first wanted the insurance it was about £480 and i was gonna pay in one, but with the problems it jumped to £1280 ish and i was forced to make monthly payments

 

they have recalculated my claim saying that thats how much it would have been with my 15 years no claims on monthly payments, luckily i kept all the refrence numbers and so forth and he could see what i meant and has applied for more of a refund but will have to wait and see

 

do not trust a company from birmingham called alpha cars, they drive a black 7 series bmw with the plate baddy p (well something similar), very well known to police and insurance investigators
