As per the title, I'm in court tomorrow on what I see as a bit of a trumped up driving charge.

 

The history is this:

 

Last November I got a letter asking me to confirm I was the owner of my car as I had been caught texting and driving in September and do I admit that I did it? The only evidence they have is an undercover policeman said he was stood at the opposite side of the road as I came to a stop at the junction and he could see into my car and I was texting.

 

I denied it.

 

July this year I get a letter saying I have to appear in court in October this year.

 

I go with phone records showing that I didnt recieve or send any texts or phonecalls 15 minutes either side of the alleged offence. Was told this doesnt matter as I could have been checking anything on my phone. I again plead not guilty and am told any chance of leniency is over and I must attend trial on !4th November.

 

So a full 14 months after the alleged offence and with no evidence against me apart from what a policeman reckons he saw from 20 yards away what do you reckon my chances are and what can I say?

With regards to the Police Officer reffering back to his notebook, that's perfectly acceptable in the eyes of the courts as that is precisely what the notebook is there for however by stating that you were not calling the Police Officer a liar but meerly suggesting that he was mistaken is exactly what the court wanted to hear as both parties have a justification to walk out of court with integrity intact

 

Good effort mate.....however regarding the doughnuts in the car park after todays hearing, they pinged it on CCTV bud so sorry you're on your own with that one!

Hahaha everyones asked that and no I didn't! I have done a lot of things at the wheel but texting isn't one of them although probably only because I can't do it one handed haha

Haha the policeman was outside when I left and I was dying to walk over and say "actually, the phone was in my right hand not my left".

 

I was worried all the way home in case he followed me and got me for something else!

I had a sitution many years ago where it was my word against the copper and like you I couldn't believe his word was sufficient as proof - although like you I had my day in court and won :biggrin:

its a great unexpected feeling isn't it? Even though I was innocent I still thought it would go in his favour.

Thats what I thought, he's from my local station as well and patrols around my way.

Well done mate - common sense prevailed and the magistrates came to the right decision!!

 

I think the police and/or the CPS try it because in most cases, the defendant just admits it and pays the fine. But if you have done nothing wrong, then you're right to stand up for yourself and have your day in court.

Just read this start to finish, You did great, I think the fact you basically advised I dont know what was in my hand, Im not calling the policeman a liar, as sometimes I do have to pick things up, so could of been holding something, not denying that, cant remember back that far. But adamate it wasnt a phone...... Sounds very responsible, and reasonable imo - you fought a great case mate. congrats.
