I took some tyres of my old zed cos they were cheap and nasty, but still serviceable, and sold them on ebay.

 

The guy came round, gave them a very brief look over, paid me the £46 cash took them to his car and drove home again.

 

He then gave me positive feedback, but did comment that the tyres were slightly scuffed on the inside rim and that the rim protector was a bit damaged.

 

However, hes now emailed me saying hes taken them to a garage to fit them and they wont touch them - they say the sidewall is weakened too much and they wont put them on.

 

hes provided me the garage name, and even taken pictures of the area, and hes offered to drop them back round again - but obviously i want the money, not the tyres - im my mind i sold them fair and square. Admittedly i didnt get a receipt saying sold as seen, but then again if he'd have looked at them and decided they weren't as per the description i wouldnt have forced a sale on him.

 

advice? i certainly wasnt going to let him keep the tyres and have a refund, but now hes offered to drop them back round... i dont know!

If he won it on ebay then you are tied into a contract, i know on my ebay it says no returns accepted, look over your ad again.

Well i guess it's all up to you mate not sure how ebay contracts etc work , he did see the tyres before buying and then even though he noticed the small problem he still gave you positive feedback which was nice. However if the tyres arent good and they dont want to fit them and he only wants a refund , i think the fair thing to do is give the refund and take the tyres back. Thats personaly what id do mate .

If he paid cash then he is screwed because I dont think he qualifies for ebay buyer protection which would have been guaranteed if he paid via paypal.

It's not ebay buyer protection you gotta worry about, he knows where you live and I assume he aint far away. All depends how he takes the bad news. I wouldn't refund him that's for sure.

I dont think its about the legality issues or ebay protection etc as mentioned by others.

 

I would ask the garage bout the tyres, I'd explain that i sold them for less than £50 for the set and that they had been running on my car and see what they have to say. I'd look at the pics he sent me and see if they do look knackered.

 

Then i would ask the guy who bought them what he did when he looked over them upon pickup, and what did he expect for £46. I would take into account that he would have left feedback before he went to get them fitted, and the fact that he had taken photos, got the garage to back his arguement and that he'd offered to bring them back.

 

Finally I'd ask myself what i wanted to do? Two valid arguements really; on one hand he did look them over, hand over the dosh and give you good feedback, job done. On the other hand, if they are knackered and you sold him a dud set (knowingly or not) i guess the question is: Do you have a moral responsibility to ensure that someone else should not lose out due to your original misfortune of having dud tyres on your zed?

 

S'up to you really mate, like i said you could argue a pretty good case from either side of the fence.

Lot of garages wont put on second hand tyres anyway i have to use a back street garage if i have some part worns so that may be his problem. Also a garage will tell you anything to get you to buy new tyres off them i think that is the problem here

Do you have the pics of the tyres that he sent you?

he knows where you live as he collected?? give him the cash back... for the sake of 45 quid.........

mixed opinions it seems...

 

martys point was the first thing i mentioned, obviously a garage cant warranty a part worn, and would much rather sell a new tyre. Ive suggested taking it to a different independent fitter and getting a second opinion.

 

I don't believe that the tyres are shoddy - i'd put them back on my car even after what the garage has said about them cos they were fine when i took them off - apart from being a cheap tyre!

 

Unfortunately he does know where i live - although hes not particularly close by (the other side of birmingham to me). i suppose if he brings them back to me, i'll just put them on ebay again, albeit with a slightly amended description, and then make sure the next seller inspects them before buying, and get a receipt for sold as seen.

As said, from an ebay point of veiw, its a done deal.

sold as seen i think you should tell him to go to another garage sounds like they are pulling a fast one unless the tyres have been run flat then they would be damaged. If they havent then there shouldnt be nothing wrong with tyre walls. Think it is a classic case of a garage trying to take advantage not many genuine ones out there anymore

Why dont you just give him his money back. It's the right thing to do. It's not anyones fault just one of these things that happens from time to time. You didn't know the tyres were iffy and neither did the guy, he bought them in good faith.

NO WAY would I give him the money back.. but I would take the time and find a garage that would fit the tyres to the wheels for the new owner. And then I probabaly find another one just to hammer a point home. For an hours hassle you get to keep the cash/ a clear concience and the wheels are sorted.

 

Go the Gonzo12c path.

Part refund (e.g. less eBay costs) and recommend a garage that specialises in part-worn tyres is what I think I'd do.

Put it this way, rubber is the only thing between you the road and an accident. I wouldn't put second hand tyres which i new nothing about on my daily driver, never mind my Z, so in my opinion, "you pays your money, you takes your chances"...

the old ebay "no win situation" here i think....ide give him his wonga back so iff only you can sleep at night then re-list them but offer the tires free iff the bidder pays x amount for a valve cap:whistling:..a sale with no comebacks:cool3:

He saw the tyres off the rim, I take it?Im guessing the garage he went to wont touch it for their own reasons,not because they tyres are un safe..,put it this way,would they fail an mot?

I think id refund him all the same,just to keep the peace,good karma an all that,you can always relist them on eb*y..(although he did see the tyres before buying,but maybe he hasnt a clue about such things..)Put yourself in his shoes,think what you would do in the same situation,would you ask for a refund or shrug your shoulders and let it lie.Either way,your gut instinct is usually right when it comes to these decisions.:)
