Hi All

This is my first time in starting a thread so i'm a thread virgin.

 

On Tuesday I came out of my local shop to get back in my car. I went onto the road side of the car to get in the drivers side and saw a little blue mini coming towards me. I didnt open the door but waited thinking it would just drive by as there was nothing else on the road. The next thing I remember was coming round with three or four people around me. The driver of the mini had clipped the back of my car and hit me sending me over her bonnet and clipping her roof. I was told this by the lollypop lady who saw it all and tried to stop her with her stick, but she had carried on. I was given the reg number so phoned 999. The dibbles came to my house five hours later and questioned me saying that the driver of the mini would not be approached regarding the matter as she was 72 and it would cause her much distress, I went nuts and the dibbles left. Yesterday I contacted the head of Barnsley nick and he told me the case was not worth persuing as to thhe drivers age and the CPS would not prosecute. I went to the drivers house to ask her about the incedent and she said I was talking rubbish, it never happened, and she was calling the police to report me. 20 minutes later I was being lectured about herrasment and do not contact this person again. Today I have phoned the solicitors and they are trying to sort it all.

 

The moral is start drivng your Zed as you like after you are 70 and you are immune from the law. :asshole:

Really shocked at the attitude of the police, glad you are taking legal advice. Hope the people who helped at the scene gave you their details too!

Thing is can you prove it was her? Get a match on the paint of her mini from your car and have more than a witnesses account and recollection of the no. plate? It's a sh*t deal though..

there is someone who lives near me, he cant walk for shit, uses a Cain, hands all over the backs of other peoples cars to steady him self, takes 15mins to walk the 25meters or so to his car, when reversing he makes sure both rear tires are on the curb before he rolls back forward to park, and the law says hes fit to drive? wtf is this country coming too

I truely beleive that evertybody should be retested at regular intervals, say 10 years or so, and said intervals should get get shorter as you get older.

 

Not only would it generate some jobs and revenue, but it would keep many unsafe drivers off our roads.

 

I mean we all know that your sight, hearing and reaction time deteriorates as we get older, but yet we are happy to let someone who passed their test 50 or more years ago to carry on as if they were 50 years younger.... Cars have to be checked to ensure they are roadworthy, why not drivers??

 

I am sorry to hear that you were on the receiving end of what sounds like a nasty experience, but i aggree with those above - you should definately pursue, and get GOOD legal representation.

 

I am pleased that you are ok, but it grinds my gears when we, as a society insist one rule for some, and another rule for others.

I would definetly pursue it if you have a witness. Or contact the CPS directly! Most police are about as much use as tits on fish.

 

She should do time for leaving the scence of the accident just as anyone else should. IDGAF how old she is or ANY personal circumstances. Needs to have licence taken off her and get the bus like every other OAP who shouldnt be behind the wheel.

Sorry to hear about the accident mate but agreed age makes no odds to the law or should'nt!!!

she should be banned from driving if she isn't aware that she had an accident and if she is and as forgotten about it... well just as bad or worse....

Surely if you are too old to face the old bill if you do something like this then they really need to take her licence away as she shouldnt be driving in the first place!

I agree with all the above, what if she had put you in hospital or worse, would the police do anything then? I thought driving licenses were only valid till you were 70, then you would need a retest, she may not even be legal.

Definitely persue it, sue her and the police, its a disgrace.

Just wait for a really frosty night and empty 5 ltrs of water all over her path.

 

Then go and visit her in hospital when her pelvis is fractured and exclaim your sadness at her unfortunate 'accident' and tell her you have no bad feelings towards her if she were to, unfortunately, heamorrage and die...

You could blame the doctor she is under, as they have to pass her fit to drive , i think its at 70yrs old ,they have to get a medical and then its every so often after 1 or 2 yrs i think.

that sounds awful mate, the attitude of the police astounds me the most here.

 

what if it had been a little girl or boy waiting to cross the road and they got wiped out by that dozy old bat!

That cant be right, just because your old does not give you the right to drive with out due care, cause an accident and then leave the scene. Get your solictor to sort out the driver and the police and what about the damage to your car?:no:

I really hope you get it sorted - despite the age issue she (or her insurers) still has the matter of repairs to your car and your injury to deal with. Whilst the police have behaved disgustingly, everyone must still have 3rd party insurance - that part of the law is not in dispute!!

SHOCKING if she had seriously hurt you or god forbid worse would they have let her off then!!!! takes the F-ing piss, I watched a few weeks ago as this old boy mid 80s, who should not have been driving pulled out of a jucntion without looking right infront of a bmw who had no hope in hell of avoiding him, Both cars then carreared into a school bus full of kids!!! it was horrific. The old boy didnt even remember getting in his car that morning. Im Sorry most OAPs are now driving on licences over 50 years old and have no idea of what current road signs mean. Manditory retests starting at 65 should be introduced and done every 5 years.

Fookin mad.......just can't believe what UK is coming to when it comes to the law. You can't get done for anything when your young and looks as if you can get away with shit when your old.

OMG. Im speechless. Im glad your not seriously hurt, but the police/cps response is outrageous. it has to be persued.....go the legal route, perhaps the Doctor angle as suggested....and if all else fails then go to the press. She has to at the very least have her license revoked and you should get some sort of apology.

It is an amazing story, I cant believe the police dont want to persue it!

 

I agree she should have her license taken of her and also with the re- tests every few years, even if its a reactions test/hazard awareness rather than an actual driving test as such. As sight might deteriorate it doesnt mean that they cant actually drive anymore, its just they cant see where they are going!

Although, I was in stoke the other day an old couple got into an ancient micra and attempted to reverse out of a space and drive away. Poor thing must have been running at around 5k as she was manouvering. A que of cars either way waiting for her, I felt sorry for the car in this case more than anything!

 

I do think we should have tougher driving laws, in this country I know people say its hard to get a driving license. It really isnt, a few lessons and you can take a test that really isnt that bad. If the test was tougher, and required more skill then the overall quality of driving would improve. Also, if it was harder to get young scroates that just drive like maniacs would have had to work hard for the license so hopefully should respect it more. We do absolutly need a mandatory test for the motorway as well. So few people understand how to drive on them properly, they dont read signs or use the correct lanes. I drive alot for my job and the amount of things I see each day does make me think "dear god no wonder there are so many crashes and insurance is so high!"
