Parking eye

Anyone had a letter from the independant car park lot called Parking eye? I overstayed my welcome in a industrial car park that they had signs up in. Did a search on google and came up with money saving expert forum where everyone says not to pay it as they will never take action and it is just a mere scam.

These private firms have no right in law to demand who was driving the car at the time; unlike the safety camera partnerships.

 

Sure, they can send the registered keeper a penalty charge notice but you are not obliged to say you were driving. And that is the important part.

 

It is the driver who parked the car and entered into the contract with the industrial park owners; not the car's owner. So you admit to owning the car but not driving it at the time and there's nothing they can do. In fact I had one a couple of years back and I sent a letter saying pretty much that.

 

I finished by saying that "I would reply to their first letter free of charge; and my second and third letters would also be free. However if I received a 4th letter then I would levy a charge of £50 for replying to that; plus a further £50 for each of my first 3 letters to cover my time and inconvenience. Furthermore my invoice for £200 must be paid within 7 days otherwise I will seek recovery through the small claims court for an unpaid debt; along with further damages for the emotional distress [they] caused me in hounding me for payment of a fine that was not my legal responsibility!!"

 

You know what - after I sent a second letter - which was almost exactly the same as the first, they soon dropped it!!

I have had something similar in the past, sadly i was in my work van so it went to the company, they paid it and sent me the bill... grrr! So i didnt have much choice but to pay it!

 

All done by ANPR, and I am positive there are no signs up because I have used that car park several tiems in the past when visiting a pharmacy and never had an issue.
