eBay and BACS

I recently purchased a mountain bike for £500 from eBay and paid via BACS. 19days later and several promises that the bike will be posted 'tomorrow' the bike has not arrived. I understand that BACS isn't covered under the eBay Protection Scheme so I was wondering if anyone knows how to escalate the matter to a legal one? Is it a police job?
