Currently very p1ssed off.

 

My folks, who own a hair/beauty salon (over 40 years in the same location) received a letter this morning from the solicitors of a waste of perfectly good skin who has decided to sue us. The reason: he walked into our sign outside the salon parking area (the sign that is about 5ftx4ft large I should add). Apparently the sign hangs 3 inches too far over the pavement and caused him to cut the top of his head (the bottom of the sign is about shoulder height so I can only presume he's either a midget or was limbo-ing at the time). Unfortunately this has completely stressed my folks out (and my wife and I tbh) and I can't stand seeing them so upset...they're good, honest, hard working people that truly don't deserve this kind of thing. What's worrying us is will this "overhang" negate the insurance? None of us are well off and if we're not covered this could really do some major damage. They're just trying to get a straight answer from their insurers now but with the recent snow fall the chap they need to talk to hasn't turned up to work! :(

 

It's exactly this kind of needless compensation mentality that makes my blood boil. Really wish I knew who the little tVrd is...I'm presuming he's local as he's using a Birmingham solicitors.

Sad to hear. I don't think I've ever tried to get any compensation from people, even when I had a chunk taken out of my leg by a dog. I just told the owner to bugger off.

 

Even mistakes I've made like walking into things or falling over, I blame myself. Shit happens, "I didn't quite look hard enough where I was walking" is usually what I think. I am quite clumsy at times

tbh unless the sign is considdered dangerous you should be ok as it is his fault for walking into it.

Can you not ask the local council if the sign is ok and legal where it is? if yes I dont see how he can claim, if not then best get it moved before it happens again, someone else may try the same trick.

Just off the phone from the insurers (after being thrown around 5 different people to finally reach the correct person to talk to!). They've said not to worry as they get 1000's of claims like this. Due to the height of the sign they don't think he has much of a case plus there were no witnesses or CCTV/security footage. However, they've advised us not to move the sign as it would be seen as an admission of guilt and they're sending their own assessor round to check it out (getting onto the local council isn't a bad idea though :)).

 

We're now going to have to hang a sign on the sign asking people to avoid the sign...Monty Python anyone?

It certainly is crazy, it seems the human race is dead set on messing the world up any way it can, they dont realise the knock on effect these claims have or who really foots the bill in the end !! good luck and fingers crossed all will be fine, as they said, without proof or a witness he can not have much of a case.

tbh i would completely ignore him, did he come into the salon when the alleged incident happened, and say to anyone i have banged my head off your sign and i think its dangerous etc. etc. otherwise without cctv or independent witnesses it could have happened anywhere, i hate that compo culture mentality

As Tulip says, even if there is an issue with the sign where is his proof that he hurt himself on it.

THis might not help but wouldnt it be wonderful if you could sue him for trespass for being in your car park without a car or permission.

tell me about it mate. there was that woman in the news a while ago that applied to loads of jobs, and i think anyone who turned her down she sued for age discrimination. they found her guilty though - hopefully she'll get to meet every strap-on in cell block H ;)

some things are deserved of compensation, this isnt one of them :nono:

If your not paying attention then its your bloody fault, if it fell on him then it would be a different matter, maybe you should give him a free token for specsavers :hyper:

Make sure your insurance company fights it, and from what you are saying it looks like they will. Sometimes insurance companies can settle without the insured knowledge or approval if the claim amount it small.

Thanks for all the comments guys. The folks are feeling a bit better about things now which means I am as well but I know that beneath the surface they're still worried and this is the last thing they need.

 

You sometimes forget what cretins this world can throw up...then you get stuff like this which reminds you. Sad really.
