Mick hope you won't mind me responding but I work in the business and can't understand why any party representing you would allow the hire to continue to that level given the other drivers circumstances. if your partner has a courtesy vehicle thats one thing, if its a 'credit hire' vehicle then your partner remains ultimately responsible for any hire charges incurred, albeit the principle is that any 'reasonable' hire charges can be recovered from the other driver/or his insurers (assuming negligence is admitted and assuming they wil indemnify the driver, which in this case they may not). I've assumed for now you haven't hired personally and privately. it also begs the question why if a figure of £1,400.00 for the total loss value was agreed in Aug 06 did they not release an interim cheque, entirely without prejudice to liability etc, to you at that stage to bring any hire to an end and mitigate. if they haven't released a cheque under those circumstances they are unlikely to, ever. most credit hire agreements (exempt agreements) would generally end after 84 days. I wonder if you may have got round this by signing further agreements every 3 months or so? further, the Court would look at whether, even given the unfortunate circumstances, it was reasonable to incur hire charges of over £20K rather than purchase a replacement motor for a fraction of this. the issue of negligence (fault) is immaterial to this point as you and your partner have an overiding responsibility to mitigate your losses. hope everything turns out ok for you. talk very seriously to your own representatives about this.
  2. unfortunately, at the moment your claim against the MIB will take a very long time. they had to release some staff earlier this year and currently have a very large backlog of work. their response time is between 2 and 4 months at present. however, it is generally a better way of recovering damages rather than simply issuing proceedngs against the other driver and pursuing him directly. even if and when a judgement is received, inforcing this and getting any monies back is never guaranteed. if and when you are medically examined this may have to be via the MIB's agents because they won't always agree to meet the fees otherwise and this process can cause further delays. if the MIB deal with the claim on behalf of the uninsured driver and later establish he has any assets they will issue proceedings against him themselves. best of luck.

  4. slightly off tangent but even when hopefully the criminal side of this has been sorted you may receive a letter from Solicitors pursuing a claim for damages on behalf of the child. the fact the injuries are only minor won't be a barrier to this as for claims on behalf of children, even if damages are only negligable, the solicitors costs etc can be recovered so someone out there, depending on what story they are told, may look to take the claim on. the claim would initially be sought against yourself but your home insurance policy should hopefully provide you with cover so it may be worthwile checking. they will not simply settle the claim on your behalf so the more information, particularly in relation to a timeline of events you can give them the better. it may therefore be worthwhile documenting everything you can now whilst everything is fresh in your mind and keeping a diary of everything connected including specific times and dates, police references etc, etc. very best of luck.

  8. not a problem Ste mate its an emotive issue and as Zed owners we feel high insurance premiums more than most. however there is a big difference between the claims marketing companies that go into overkill and the firms of solicitors out there who actually run cases sometimes the two parties are obviously classed as one and the same. your comments with regard to certain cliams companies are probably relatively accurate but unfortunately i'm sure you understand I can't comment further on that. the offer of help and advice (without prejudice) would extend to any Zed owner in these circumstances but particularly to Mr Berks whos from my home town. for Mr x-biker you have my sympathies, the odds are stacked against you to start with and its very rarely fair.

I do appreciate that could have sounded a little bit like ambulance chasing which wasn't my intention at all and I certainly wouldn't encourage Berks or his Bruv to claim if they are perfectly ok (as I hope they are). I just wanted to avoid a situation some weeks down the line where one of them may struggle to get someone to help them with the claim because they had not done the necessary groundwork just in case.   10. You and your Bruv should both get to your GP's regardless this week, you never know how these things will pan out and it could be this weekend before either of you feel anything. Also, don't repair the motor yourself regardless whether its comp or TP cover on it, take photos aswell not only exterior but also interior, if you can, your digital camera will also record the date I assume. Please do not take anything for granted. I'm sure you and your Bruv are both tough but you should both consider making a claim, its nothing personal against the other driver, these things just happen.     sony head unit (1 out and 2 pre outs, I think) kicker 5 channel amp runnin 6 infinity's 2 x 6" comps 2 x 6"x9" s 2 x 10" subs all custom built as I'm no engineer believe me.
  12. I've had my NA for 6 months now and bought it more by luck than judgement but it was probably the best thing I have ever done. I'm sure the driving experience of a TT is better but the general public at large couldn't tell the difference and owning a Zed gives you fantastic kudos.
  13. mines the midnight blue na with a tt front valance, no rear spoiler and 18's. i've also seen the geezer with the other red Z (J reg) in Nuneaton i think his is the one with a pair of 6" rear cans. mine only comes out saturdays and sundays though. no doubt we'll cross paths soon pal.
