Hi Guys,

I would like to ask for your advice regarding a very serious Ebay matter.

I recently sold my previous car on Ebay. It was in excellent condition, I had it serviced 5 times I think whilst I had it, which was only 2 years and 4 months. The car also recently had 2 new front tyres fitted and the tracking done at the same time. I had the receipts for this too!

I also had the AC re-gassed last summer and all was working fine. I had lots of receipts to show what work was done and he himself thought it was impressive! I was very sad to see it go, but it had to let it go in order for me to afford my 300ZX.

I had many bids on the car and a lot of interest. The winning bidder came out of the blue, he was a new bidder in the last 5 minutes of the auction. He didnt ask me any questions about it on Ebay or come to see it.

He wanted to pay cash and pick it up the following day, which he did. When he arrived, he was with 3 other people. He wanted to check everything, which I agreed too. He checked the brake lights, reverse lights, fog lights, indicators, hazzards, electric windows and all the other electrics. He also checked the AC and he confirmed it working.

He then wanted it to just idle for a few minutes to see if it revealed any unpleasant secrets, which it didnt as the car was faultless. He DIDNT ask if he could drive it and I DIDNT offer as I assumed he wasnt insured as he didnt know the cars registration number! I took him out for a good 20 minutes ride, including on a fast dual carriage way.

Upon arriving home, he wanted me to leave the car running to see if it over heated. Again, he found nothing as the car was faultless.

He paid the full amount of the car, but requested a discount. This goes against Ebay's policy. I said NO as the car only met my reserve and I want the full price.

Anyway, OVER A WEEK LATER, he contacts me saying the AC is not working and the wheel shakes at 60 mph and wants to know what I will do about it.

I responded with a polite email, stating that as a goodwill gesture, I would pay for the front wheels to be re-balanced as this could only be the cause of it. As for the AC, this was all working and so was not prepared to do anything.

And as a result he has now given me negative feedback and has contacted Ebay, who have now suspended my account as he told Ebay that the description was 'Significantly Different'. I have a good feedback with never having recived a negative before.

This bloke desperatly was seeking a discount from day one and I feel that this is a way he thinks he can obtain it.

What are your thoughts on this? Please help as I feel victimised!

Contact E-Bay, and confirm what you have here, stating everything as it happened. If they won't listen, then there isn't lot you can do as far as you e-bay account goes (unless someone can correct me on that point?)

As far as the purchaser is concerned, SOLD AS SEEN, I assume you never implied any form of warranty in your auction description? So basically he doesn't have a leg to stand on! And that is the law, which is entirely in your favour on this account!

You assume correctly, no warranty was offered.

However, this is not the point as I have done nothing wrong. I have contacted Ebay explaining the matter but not as detailed as above!

Ebay suspended my account straight away! I thought they had to give 10 days before they could do this. What if I had bidded on something or what if I was selling other items? I think Ebay has made a mistake!?

Here is my original Ebay listing:

This is a big problem with e-bay, all someone has to do is put in that sort of a complaint, and they WILL instantly suspend an account. They don't ask questions, they don't investigate, they simply instantly convict you as guilty, and thats that! Totally sh1te system, completely full of flaws, no real people to talk or complain to when things go wrong, as in this case.

But, as I said before, e-mail them and explain FULLY the situation, and see what happens. It'll probably take a while, as they don't really give a **** who's right or wrong, as long as they are seen as doing something when a complaint comes in (rightly or wrongly)

Sorry i can't really be of much help, but thats the way the shitty system is.
