:confused: after a leeter received from the police, I have just made a call to the police follwing my allegation regarding my 300zx that my accelerator was stuck. ive been told after 1 month that they wont let the insurers deal with my car untill they have finished inspecting the vehicle. if they find that theyre was no mechanical fault then i could be done for driving without due care or which i may get a mininum of 6 points.

 

got any advie for me im scared now that everything will ok with my car. how do the police check the vehicles?

not wanting to fear into you, but i'd say its a safe bet you will get done mate.

 

with a stuck throttle, they will still claim yuo should have used clutch or put her into neutral mate.

 

 

i hope they find a fault but my gut feeling is they wont, too much on the engine to look for

there was a wire on the accelerator which was from the turbo gauge maybe they will see that and think that could have been the cause. just dont want to lose my licence im 21 been driving for 5 years.

i doubt you will lose it mate, unless you already have points.

i don't know the situation, but i hope whatever is just prevails. if your accelerator wasn't stuck down then it's your fault...

Not good mate, if they find a fault then they will look at it to see if it was a fault that could have been rectified by you if so they will do you for not having a road worthy car, if they dont find a fault then the will do you for driving without due car, which ain't a 6 pointer mate its a Ban IIRC ( will ask the mrs when she gets back from work).

TBH if the accelerator didn't stick and you genuinely fooked up, far better to come clean sooner rather than later, from your original post it does seem as though you overtook in the wrong place and are looking for a get out of jail card, pardon the pun.

I dunno if it would help but you could point them to the bit of pipe near the throttle bodies that causes the accelerator to stick, if its loose then thats probably all the evidence you need, being a design fault I dunno if you could reasonably be held liable.

sorry to say it but as others have said,if it was a mechanical fault then its down to you to have your vehicle roadworthy and as said again if your throttle jammed you dip the clutch or turn the engine off,afraid if i was the judge i'd be asking if you never hit the other car when were you planning on stopping or just let it go all the way upto 160mph???

 

sorry but i see it as being driver error regardless,as said if you were just being silly overtaking in a dodge place(we have all done it)best bet is to put your hands up

just been reading up on this, it would also seem, if your car has had an mot recently, or been serviced or had ANY engine work, the garage involved could be brought in to provide evidence, that would be used to either prosecute you, or if proved a fault, the garage could be sued....which way you think the garage will go ?

The police have qualified vehicle examiners and they will go through the car with a fine tooth comb and will find any problems which could have contributed to the crash annd more importantly if the accelerator stuck.

Ah, but its a known fault that he had no knowledge of before the crash, I also think its something he couldn't reasonably have known about or checked for.

I mentioned it before but Indian, you were posting just before the accident that your car needed a lot of service work, including brake replacement.

 

If I were you I'd get those (and this) thread deleted.

Depends what the letter you have received says. However after 4 weeks they should have finished inspecting your car, it seems to me that they are being unreasonable in keeping it now . From what your original post about the accident says I would assume you will be reported for S2 or S3 of the Road Traffic Act. If it's S3 consider a guilty plea, fine & no of points will be less. You should not be banned unless they require your personal attendance in court.

If it's S2 then you need a solicitor as there is a distinct possibility of a ban and even a custodial sentence.

Your insurance co may supply you with a solicitor especially as the other driver was injured but if not you should seek legal advice.

Well. Its a sad thing that any member on here has had a crash. BUT! If you think about it the way the law will see it is like this: You were in a situation where you were overtaking another vehicle. The other vehicle manuvered to turn right and you collided with that vehicle. You then turn round and say that the throtle jammed. That I am affraid to say is suspect from the off? I dont wish to see you punished Bhav but to be brutally honest I think you are trying to pull a stroke. Fair play to you and all that but at the end of the day mate................. Think about it. The old bill aint stupid. Sometimes unreasonable but not stupid. You have a car that is not for the faint hearted and they will know exactly what its capable of.

Not going to pass comment on anything here, but bear in mind if you go to court and lie and the magistrate or judge thinks you are blatently lying about something you could get done for perjury, then you WILL go to prison.

Just tell the truth and you are more likely to fing the magistrate is fair to you. If the truth is that the accelerator stuck then say that, if its not, then come clean, asap. There is also a possibility of getting into trouble for providing false statements to police.

Ditto that the overtake was not good overtaking when a car is turning right is going to look bad for, sorry to say. Good luck though.
