Ok guys, I am coming to you since I figure one of you will know a good solution to this!

 

I bought a Seat Leon in December from a dickhead called Andy at AJB Cars in Surrey. Its a private dealership thingy. I was told I would receive a 12 month premium warranty with it. When he originally filled the warranty form out I was reading it and he said "Ah no need to read through it, I've filled it all in" and I told him I would read it through anyway before signing it. Turns out he'd "accidentally" (my arse) filled in for 3 months of the cheapest possible warranty!! He corrected the form and "sent it off" later that week.

 

I never received anything and so called him a few weeks ago and he denied that he would have ever offered me that warranty. So i have photocopied my form and sent it to him and he is now saying on the phone 5 mins ago that he needs to contact the warranty company to see what they say!! He hung up on me and is trying to patronise me calling me "young fella" etc. He is stalling me and I know it is going to be very hard to get my warranty out of him. I have threatened Trading Standards etc in my letter to him...

 

What do I do? If I can't get my warranty from him then I will ****ing smash up all his cars and see how he likes losing money!!! ARGGHHH!H!!!! :mac1: :mac1: :xxx: :xxx:

 

Any ideas lads?

get ontot he warranty company and tell them he is fraudulently using them as a selling tool, and then not doing it, they could refuse to supply him in the future, and could offer you the warranty direct possibly

ajbcars.com is still available as a domain name if you fancy nabbing it for 7 quid a year. I can copy and paste his site and let you add/edit/remove anything you want :D

 

Its very easy to accidently stick in .com rather than .co.uk and it only takes one person to cock up :D

as you have this in document form that he filled in it is a legally binding contract. if you are not satisfied goto trading standards they will gladly pursue this idiot.

 

also the mis representation of any good for sale is against the law, you will be withing your rights to get a refund on the car as it was sold to you by unscrouplulous means.

£7.99 for the domain, £10 hosting then when he finds out, offer to sell him the domain name for the price of the warrenty to avoid him losing trade :D

Those aftermarket warranties, as TMTTP says, aren't worth the paper they're printed on. More often than not a dealer will us the small print on them to get out of fixing a car (claims limits, what's not covered exclusions etc) which he should rectify due to the Sale of Goods Act, regardless of an aftermarket warranty.

 

Your normal consumer rights far exceed most of these warranties.

 

All car salesmen are professional liars. Well, 95%+ IMHO.

Have just got off phone from Consumer Direct / Trading Standards! Very useful.

 

I can sue him for £30 going by the Misrepresentation of Goods Act '67, for being induced to buy something which was promised but not delivered. Also, can go under the Sales of Goods Act '79 as I have just had my driver's side Spring and Arm replaced cos they broke.

 

I can demand an entire refund (which would be nice since I was thinking of selling anyway!) for my car or just demand the warranty.

 

My Dad is a witness and I have written contracts and a letter that I have sent him. This guy might have done me a big favour and might be helping my entry into Nissan World :D :D

Another job for Mr Wilson, he can usally sort anything out.
