Hi Ladies and Gentlemen,

As many of you know ive fairly recently bought a zed and ive had many problems with it, all of which im overlooking apart from one which id the fact that the gear box is dead.

Now because of this i spoke to the person i bought the car from and he promised to help me out money wise to get it fixed.

Now suddenly when ive told him of the problem he's dissapeared and not answering phone etc so im going to take legal action to regain the costs under consumer protection, he told me there was no problems with the car (which i have txt's etc to prove him saying it).

 

Ive spoken to a couple of people who all think i have a very strong case so it looks like thats what will happen as he isn't getting back to me.

It comes as part of consumer protection.

 

Its not something i wanted to do however its what alot of people think i should so im going to unless he gets in touch

 

Just thought i'd let people know.

Im not going to bad mouth the guy but if he does decide to get in touch it would obviously work out better for him

You bought from a private seller ? Then you purchased it sold as seen and I dont think you have a leg to stand on. Sorry. (Unless somebody can confirm otherwise)

This isbasically exactly what happened to me mate..So i can sympathise with you....

 

Breytt claimed lots was done to it, piston work etc etc, the fact it was a 503bhp car with nitrous that was even connected, jets etc etc...

The fact he'd beaten lamborhini Murcialago's in it... lol! He made up so much crap, i almost believed him!

 

Fight all you can mate.. I gave up after a while, hes still got a load of my stuff he's been promising back fro about 3 months now, but no sign....

 

Just hope you come out better off than i am, im 6k down, and am having to buy a 600pound car to have as my ne whobby because of some greedy ****ers on this planet who are always on the look out how to earn more money and dont care what hurt is put on other people....

Apparently as long as i can prove its been mis-sold then i can claim all of the money back and also court costs etc. was speaking to people this morning who's actually been in the situation. Thats why i still have txts and things to prove what was said

i.e. nothing wrong with the car etc.

Its apparently a bigger thing than people know, also nothing was signed to say sold as seen or anything

Was it working when you baught it? Cos if it was he can just say well its a 300bhp car. you have been ragging the arse out of it after your bought it and broke it yourself. Nothing to do with me.

the only way you could possibly win this is by a means of contract, also if this was an ebay advert or autotrader you may be able to get a copy of the original advert, save it and print it out, thereby having a legal and binding contract of sale of good, and under the trades description act it is against the law to sell an item that does not meet specified conditions related to sale.

 

however, if it you have none of these and its your word against him then its circumstantial and good luck in bringing a civil matter like this to court, it will be expensive and long fought, then burden of proof will fall to you.

 

these are your options as you stand under uk law im afraid.

Bird has been on the site since bying the car asking about how a car like his should perform and and there are even some threads back and forth with the seller. He has had questions about the power and how the car seems to be poorly performing for what it is. I was sold a car once which was a cat D write off and before I bought it I asked had the car been in any accidents and the owner said "NO". I have been following this story from the begining and I feel sorry for you.

sorry to say mate, even though you new it had these problems you still bought it, he can quiet easaly say i told him about everything, also if he see's this chat were having on the forum HE could use that as evidence, coz your admitting that you new that it had problems, sorry mate, i work with the law all the time as a body guard in london and you wont have a leg to stand on, your best case is to sort it out your self (if you know what i mean).

Karl one thing Bird left out is that there are threads on here where the guy said he will pay pal some money to Bird to help out with the costs.

lol, that doesnt necessarily mean anything.. I had texts saying that Brett would give me time to sort out money.. 3 weeks later, the car had dissapeared.....

 

Ive had texts with him saying he is 2k overdrawn, yet on here there are posts saying how hes spent money on thsi and that, yet according to me, he had no money to give me back even thoguh we had a deal sorted....

I didn't know of the problems until i got back and been driving it a while, i have txt messages saying that he didn't know of the problems and would help me out, you wouldn't offer to help if you'd sold something in good condition would you??

Also there is the origional advert on her and also threads where he posted replied to me.

 

Also there is a transmission place saying its been broke a while.

I wouldn't care if i'd given him a dog but i never, i fixed any problems that the mechanics picked up on and also even bougth some standard spring for him because of the hard ride the car had! ! !

Game over. he can walk away scott free from that comment. If you didnt know about the problems and been driving it for a while he can say that you have caused the problems as they were not apparent when you first got the car :(

Yes but i only drove it up to hartlepool which wasn't far, when i stopped i could smell burning which i didn't know what it was (its the oil in the gear box) Then a transmission place has said its been on its been like that a while!

Really dont like yuor chances on this one. Hope you do get something sorted. But to me it looks bleek

To be honest with with you mate the people on here have seemed very helpful The north east guys StellaZ, Cadpaul and Mujina have all been spot on, Kirbz has helped me out with parts for a conversion apart from a flywheel which Fastorquer is getting to me,

Also other guys always being around to reply to the posts i put on here such as yourself and many others. It all helps alot to be honest im just hoping to get sorted out soon mate and dont like thieving people, the car i gave to him had £1000 Fox RS10 alloys which would have paid for the conversion so im a little disappointed really.

from my long exp in the world of debt all i can say is it takes money to chase money the issue of who is right will be a judges decision...do you have a fighting fund (from claim to enforcment this is going to be at least £200-£300) and more so does the other party have an income...if not don't bother

 

btw if you want to avoid this or any forum thread for that matter being used against you in court paste without prejudice on the top
