well yesterday I was told by the co.council that they do not pay out for pothole damage because of "non-feasance" disclaimer which they use against everyone who tries to claim.

After doing some research on older cases in the newspapers I found they were correct. No-one in my position had ever been paid regardless of photos and evidence.

So after two weeks of biting my lip with them I finally lost the rag yesterday and told them if I didn't hear from them within 24 hours I was contacting every newspaper and talk show in the country and tell them what I'm paying 1200euro a year road tax for, and let everyone in Ireland know what a bunch of incompetent crooks Waterford co. council really are.

Guess what??? Nissan garage call me this morning to tell me an insurance accessor from the council had just left after examining my car, and approved damage to the value of 2000. ;)

I still have to wait for a decision, but I don't think they would have suddenly sent him after 2 weeks of sitting on their arses unless they were taking me seriously!

Well done mate, sounds like great news! Hopefully it should all come good now.

Cheers,

Excellent Mick :nana2:

and after they pay up... goto the papers anyway..

keep at 'em. They charge us enough to be on the roads and its high time they keep them safe for us to use. Fooking councils, consistent in only one area, being goddamn useless twxts.

do you know the scary thing, if you went to your solicitor, even though you pay him/her to help you, and if you asked to bring a case against the council under the terms of the primary lease drawn up under old law governed by representatives of the queen&treasurer act , that the solicitor under the hypocratic oath they took cannot pursue that?

looking over some old law books the other week and speaking to some friends and one of the conditions is that they will not divulge information relating to queen and country, that may with due cause present a case against the monarchy under old law.

basically you would be taking the queens treasury and the banking institute of the uk to court as the banks own the U.K and the queen holds power of the banks governing.

this even relates to all lands previously "owned" by the commonwealth.

also if you had got it to court the judges are also bound by a similar oath.

you will never get to know who the original land owners are as then a whole new problem arises.

By making those people appear in court you can then argue the fact of your mortgages!!, as when you take a mortgage out you enter into an agreement with the bank yes... nope.. your debt is to the primary leaseholders of the land and thats hidden away in old law and deeds, which you will never see.

so by bring those people to court you could in theory have your mortgage dismissed as you never agreed to take a mortgage out that in turn is held against those deeds and in such your mortgage is against the law and fraudulent. you could then claim damages and they would also have to forfeit the land to you under old law, laws which they are slowly removing year by year.

there are many many old laws that are still in effect that not many of us know about.

heres one..

you can urinate in public as long as your right hand is on your car and you pee on your wheel. go figure.!!

Good to hear they are taking you seriously....PK1 do you have any more gems like that? Randomly picking one out of thin air here ;) anything about drivers getting banned for driving without insurance in their first 2 years of driving and then contesting it a year later ;)
