OK where to start...may as well be the beginning!

In fact I will start with this little fella :rant: and then move onto this guy :mac1:

 

However in all seriousness..

 

Below my mrs in the flats is a woman called Becky. Now she has a cheque book with an account that has been closed. About 10 days ago she ordered an indian takeaway and 'paid' (i use the term loosely) for it with a phoney cheque. She seemed to get away with it. Anyway on tuesday just gone she ordered a Chinese takeaway and pulled the same stunt.

 

Now this is where it gets interesting.... She had given them my girlfriend's landline number and her own mobile number. Tonight the Chinese takeaway called... assuming my girlfriend was becky they told her that the cheque had bounced and the bank had informed them that the account had been closed.

 

When miss astrassuck explained who she was, and that they wanted the woman downstairs, they said this was the number that was given, and they were ringing it as the calls to the mobile had been constantly ingnored / diverted.

 

Now I know writing phoney cheques is illegal, but that's not really my problem. What IS my problem is her handing out my phone number for the unsettled account holder's to come back on, i mean WTF??!?

 

Anyway spoke at length to the chinese takeaway tonight and they said that if I give evidence about the other phoney cheque then they will go ahead and prosecute. Is it also illegal for her to give false phone numbers too? If so I want my dues, well my girlfried does, she has enough on her plate without having becky's financial shenanigans to deal with!

 

Any help / advice would be most gratefully recieved!

The offence that Becky has committed is Obtaining Property by Deception and quite obviously is arrestable.

Giving out your number is possibly bordering on the offence of Harassment - ie a course of conduct that a reasonable person would consider causes harassment, alarm or distress.

Ultimately if the police were involved you would have to provide a statement and maybe go to court and give evidence. That would depend on what Becky had to say for herself and what the Crown Prosecution Service decided to run with.

Harassment is a very flexible offence. It can be applied to numerous situations. Essentially where possible Becky would require warning after the first incident by the Police however two or more incidents would be sufficient to amount to a "course of conduct"

dont get involved, if you provide a statement saying you know of another forged cheque, you can actually end up being done yourself for aiding, as you know of a crime and failed to report.

I didn't know the first cheque was going to bounce.

i'd still tell the take away, that they need to deal with the flat they delivered the food too, and not you mate.

the phone number fraud is a waste of time (sorry) but all she has to say ios sorry for giving the wrong mobile number but i got mixed up with mine

 

the problem lies with you trying to prove that she knew her own number of b heart

 

the best thing you can do is go round and have a chat with the take away involved and try and come up with a course of action between you's

I would be very suprised to see you get into trouble for anything Ben. One option is to have a word with her but I'm sure if she is prepared to give out your number then she is prepared to make up stuff about you and try and get you in trouble. She would be the first to call police if you had words. I know her type.

This is what I am worried about causing agro with her. We have to live with her so to speak and the mrs doesn't want to worry everytime she leaves or returns to her flat

Ben I have thought more about it and the cheque and the takeaway probably is more of a civil debt and giving out your number may only be one instance. It all comes down to how much hassle you want.

Right well had a conversatio with both Mac and Vini on the phone, (thanks very much guys, you been a great help!!) and I think I have decided what the course of action is going to be. I am going to change my number first thing tomorrow and then butt out, as I don't have the time nor the will to get tied up in litigation. As Yampiedog said, it is a matter of civil debt and I will leave it at that. Suffice to say she will NOT be informed of the new phone number.

 

As far as the mrs goes with leaving the flat, i don't think she would have any problems, without wishing to sound all yardie, she is well away that if any harm comes to her or dylan then she will have 3 ex marine mac lookalikes kicking her door down.

 

Once again, thanks for all the advice every one, much apprecited, yet another prime example of how great this place is!

Your service provider should change your number free of charge if you ask the police for a reference number for a reported incident.

This is the best advice mate.

 

The take away have nothing on you besides a phone number. It is irrelevant that you live in a neighbouring flat - the take away guys don't know your address anyway. Tell them to feck off and stop harrasing you otherwise you will call the police. They should pay a visit to the flat where they made the delivery. Keep well away from any further conversation to avoid dropping yourself in it.
