Ouch, don't blame ya . Looks like he's 100% in the wrong. Hope he gave you his real details, or better again you called the law.

Sorry to see this! :(

As said, its 100% his fault

Hope all the insurance bumfh sorts itself out as fast as poss buddy!

even if you deliberately stamp on the brake to make him hit you, it's still his fault, he should have left enough room. Knowing this, my grandfather, when he was alive, got so sick of being tail-gated that he toyed with the idea of fillin his boot wiv concrete, so when he stopped suddenly, the fookers would smash up the front of their car and his wouldn't crumple, probably didn't do it as his old misubishi galant wouldn't take the weight lol

hope it all gets sorted ASAP matey, GL

Bandit...out...

Make sure you go to the doctors tommorow, and tell him your necks hurting after an accident, x-rays and bullsh1t takes time, but it's an easy couple of grand!!

ive got pics of his number plate and also him

Uh-OH, don't want to sound negative hellraiser , but it might be hard to prove. Similar thing happened the mrs a couple of years ago. Not sure how the law works over there, but unless the police are called to the scene, and you've got witnesses it's his word against yours. did you speak to him at all? was he apologetic?

He does'nt stand a chance. There is VERY little cause for driver in front to be at fault in a rear end collision. Did he accept any blame at the scene of accident?, if so, be sure to include his admittance of fault in your accident report, and be sure to report the accident to the police (its the law to inform them within 24hrs, and the Insurance company will ask for Police case number).

if you havent got witnesses then it shouldnt be a problem to get them as the law will track them down from their numberplates in your pics. If you make a claim for whiplast you will recieve the statutory £2000 settlement, however you are well within your right to puch for more especially as that flatbed truck will weigh a shit load !

Not a leg to stand on!

Sorry to hear about that Gaz

I would send a copy of that pic to the insurance company when making the claim, gives them an idea of the situation and road layout? He's obviously been too close and he's 100% to blame...Regardless!

thanks very much for your advice guys my neck hurts anyway so might be cause for concern also my girlfriend had hurt her leg

He hasn't got a hope in hell. All you have to do these days is breathe too hard on the back of somebody's car and you'll be guilty. I had a prang a couple of years ago when a BMW actually rolled back onto me but I was still deemed to be in the wrong.

Would you all stop going on about whiplash and extra claims:headvswal I'm sure all hellraiser wants is the guy to pay up and get his zed back to the way he had it.

2 years ago a huge dumptruck backed out of a yard , and smashed into the back of my wife's fiat seciento, our two kids in the back, pushing it out onto a main road and oncoming traffic. To this day I don't know how they survived. extremely lucky that other motorists saw what was happening and stopped the flow of traffic. In short the driver of the truck was very young and shit himself when he saw what he'd done.

As no-one was hurt, my wife took pity on him  and he promised he'd pay up as it was his dads business and didn't want to go through insurance.

six months later we ended up paying for all repairs to her car as the guy turned out to be from a family of cowboy builders, constantly changing business name and we had no comeback as it was too late for witnesses and all that . anyway sorry for rambling on but when people cry out "take em to the cleaners", it's not so simple.

Gaz, Really sorry to hear this mate.

As per all the others with advice. Report to police, EMPHASIZE to them that you and your GF were injured.Makesure its in your statement.

Get crime number etc Go (both of you )to your GP tomorrow.Dont ring up for an appointment in two weeks. turn up, stress urgency etc.

Or go to local A & E dept tonight or first thing..

Get someone elso to take you if possible so you can emphasize "inability to drive due to injury" etc. Dont go OTT with it just be consistent in your claims.

In addition to what i said, i wish you and your girlfriend a speedy recovery and a speedy resolution with insurance.

Sorry to hear about this - hope you, the girlfriend and the car get sorted soon.

One small piece of advice - if you do claim whiplash injury, keep a diary of all the times+places you are in pain/uncomfortable/unable to do a certain task etc.

Another handy bit of advice mate - Unless you know of a garage which will repair to a higher standard than your Nissan dealer, stipulate that you want them to carry out the repairs. You have a right to request where the repairs get carried out...

Another thing, you may get a 350z as a courtesy car due to the fact that it has to be the equivalent of yours.... This time last year some twat went into the back of my '94 325i coupe - It was repaired amazingly by BMW, and I got a brand new 330ci coupe for a week!

Sorry to hear about all this you must be f(_)cking livid!! I know i would be... Hope everything gets sorted ok though and there is no way the insurance company won't pay out, as everyone said it's a read accident.. Hope you and your girlfriend have a speedy recovery and the Z too.. A good excuse to upgrade your read end!!! Chin up lad!
