Ive taken a couple of people to the small claims, one guy I won against, the other went bankrupt, and the liquidators are currently dealing with this one for me.

Usually if you send a couple of letters giving them notice of your intentions they will repond before it goes that far, unfortunately you have to pay when you hand the forms in, so you need to have a good case or you end up loosing more and my last one was for £6000 and cost me £250, the courts will go with who they believe in a lot of cases but proof helps.

I also threatened the guy who supplied me with a dodgy recon engine with small claims and he passed it onto his insurance who have taken up responibility and are going to pay me out directly.

So it depends on the situation, but a lot of people react to threats as they dont want judgements registered against them.

Claim online is real easy mate and think it costs around 30 quid which goes onto the amount being claimed. Judgement is automatically passed if he fails to respond and they will if pushed send the bailiffs round, worth a try mate.

PaulC, small claims court is no problem if a bit nerve-wracking the first time. Very simple, bit of form filling, £80 fee (which you get back if you win).
