Car Sold - BMW 3 series 328i (1995)

 

Basically the car was not fit for sale and the customer is still waiting for an MOT (which was done, apparently) thermostat was removed, bald tyres on inside rears (not checked as was told MOT passed) sold with 12 month 'dodgy' warranty (amazing how many of these books turn up!) valves were knackered before the sale of the car and promptly died 30 miles from garage. And also the head gasket went.

 

The garage refused to take the car back.

 

The reason I'm letting everyone know about this as it's another Birmingham dealer again, I'm sure they were known as something else before 'Blitz' (another name taken in vain again, Veilsdie anyone!) and they sell a lot of Jap sports cars and I don't want to see anyone else getting screwed by these people again.

 

More naming and shaming needs to be done to stamp this type of thing out!!!

Ok here’s the story,

On (15th September 2003) I purchased a Black 1995 BMW 328i Coupe from a company called Blitz Car Sales in Birmingham. I was told the car had an MOT and that he would send it on to me as he did not have it on him (I blame myself for being trusting) promptly 30 miles down the road on the motorway in traffic the car made a strange but loud high pitched whirring sound and then plumes of dark smoke was pouring out the back of the car. I then called upon the RAC who towed the car to the garage in the morning, they refused to take delivery so I had to get it towed back here. I then got the RAC to tow the car to an approved Warranty Car Mechanic’s and was found to have the oil regulator valve and another valve not working and also the thermostat had been removed and bleed valve was broken. These where all fixed for a cost of £250 (the warranty company would not pay out), problem solved I thought, it appeared the thermostat must have been taken out to make the car run cooler so to hide the head gasket problem, it again promptly fully went after a hundred or so miles. To avoid even more arguing with garage I fixed this myself for a total cost of £55 + loads of my time and labour of friends. However the sunroof and electrics are not working now either, I took the car to an auto electrician who then pulled out the alarm system as he told me in these exact words ‘it was a fire hazard and certainly not a CAT1 alarm as advertised) this came to a cost of £100, + I will need another CAT1 Alarm. The car I was told had an MOT so at the time I did not check for things such as tyres, the insides of the rear tyres where bald, handbrake does only work on one side and headlight was not operating properly (only a bulb). New Tyres cost me £225. Since the beginning I have been in contact with trading standards, police, citizens advice bureau and countless people helping out. I have also been in contact on numerous occasions on the phone advising him of what I will be doing, getting the car fixed to as stated on the add and them charging him for the moneys. I have sent emails, recorded delivery letters and phone calls throughout the amount of things being fixed, every time he has not replied to me, or has been extremely rude putting the phone down on me telling me to just take him to court if I want anything and hanging up etc. I have most recently sent an email got no reply as usual so I rung up, and was told by someone working there he is now in another country and does not know when he will be back. So regardless of this issue I have now sent a recorded delivery letter of total costs so far a day or so ago, and have given the company 7 days to pay up or I’ll be taking legal action. As you can understand this is just a pain in the a** and is not needed. I just want what moneys I have paid out. Can everyone please post this around the web, every forum, website etc. you know of. So more people know of the company in question and so no one else will have the troubles I have been having.

 

All help is GREATLY appreciated.

If the car died 30 miles from the garage then under the Trading Standards Act of 1974 the customer is entitled to a full refund of money or fix the car, whichever option they prefer is upto them BUT Trading Standards will back them all the way.

you really shouldn't have taken on any of the work, should have reported itt o trading standards, the only way these companies get shut down is by following the correct legal procedure.

 

Shaming them on the internet may stop some people using them but there is no way it will stop all people.

Does the mobile number work?

Thanks for sharing as a work colleague is after a Z and there are some on their website. Will advise him to steer clear.

ok peeps yes i also bought my zed from this dealership

i have been in touch with trading standards and they are going to try to help me but i have also phoned the BBC watchdog programme and they have taken details and are getting back to me so hopefully they can do something:duffer:

Check if your home contents insurance covers you for legal expenses if you need to make a civil claim (most policies do). If so then they will put you in touch with a good solicitor who will advise you on how to proceed. You will probably need to get an independant inspection by someone like the RAC, and this can be used as a satement of fact in court.

 

In my personal case the claim was settled without going to court.

 

Once it's settled send copies of all correspondence to the relevant trading standards office so that they are aware of the bad trader.

Trading standards have told me about my legal rights, and sent me a booklet!

I'll be getting in touch with watchdog too.

 

dafty... has the owner bloke done a runner to a dif country on you too? or can you get hold of him?

hi matty no i cant get hold of this bloke somebody else has his mobile and nobody has the authority apparently to authorise repairs still im up at 4am every morning to go to work so may phone them on the mobile every day when i wake just for the hell of it :D

I would also have contacted the Ministry Of Transport. may be worth giving them a call, but if you've changed the tyres now there may be little they can do.

Have told them trading standards are involved and also that they have been reported to watchdog.

Then they said could i fax them a copy of the reviews that are posted so the manager can see wots going on

Most of my business is done with companies recommended by word of mouth.

You have put me and others for life. I will also tell anyone looking for a car to avoid them. Word spreads.

Perhaps they should think of that when selling dodgy cars.

Funny, never heard a bad word spoken about Miquel at Newera Imports. I have never met him or dealt with him but I recommend him.

trading standards arent always as helpfull as people think, especially if you have actually paid and driven the car off of the forecourt, i bought a z32 in april from dealer in april and after taking it to for a service a week later to check out what i thought was a simple spark plug problem (the dealer was quite far away)

 

i found that the rear brake disks were buggered, exhaust rusty, heater matrix not working (probably wouldnt have noticed till winter) and engine stumbling (mucked up throttle bodies) among other things.

 

i had an inspectors report done and spoke to trading standards.

tried to get appointment to sit down with somebody but was told that i could only have phone conv. They said that because i had driven the car home that i had to let the garage have a chance to fix the problems, but they wouldnt properly investigate or follow up this.

 

The garage had the car for further 6 weeks and fixed only a selection of the problems and i had to cut my losses.

 

i found that it was difficult getting decent advice and in general it is a case of you against them which is the most frustrating thing!

also tried phoning AA legal helpline (£1 min) and my home contents legal line, but again they bank on the dealer 1. actually responding to your letters, calls 2.the dealer actually having a concience

Have just spoken to the garage today and have been told the garage is changing ownership and the person who sold me my car has pulled out of the garage you can contact me on 07977 576456 or 01684 576778

How about a note for good dealers or even putting together a list of recomended dealers and Repair specialists. I bought a Volvo 850 T5 from Paradice Auto's in Chester as a winter car. The prices was right and only one owner from new. Full sevice history and in imac condition. After two days I was covinced that it wasn't running properley. The turbo just didn't seem to kick in. I told them and they took the car and started to fix it. they lent me a car and though a bit tatty was road worthy and ment that the Z wasn't called upon.

 

They ended up replacing the intercooler, Hosing, Actuator, dump valve and reconed the turbo all on warrenty and the car is flying. (265bhp for real in'it)The cost of the repair was £500 ish more than I payed for the car. There was no quibbling and the guy there just said "look sometimes even we get bitten but you bought a car in good faith and we sold the same. So if there's something wrong we'd better get it fix for you". That's exactly what they did. To be honest I was amazed.

 

The local unfriendly Nissan Dealer needed a threat of legal action to fix the Patrol I bought Brand New from them even though it was under Warrenty and only 2yrs old. Total time for paradice to fix and return Volvo 1and 1/2 weeks. Nissan Dealer 6 months. By the way the Nissan Dealer was Hartwells and they also scratched the wings of my Z when servicing it because they didn't use covers and refused to pay for repairs.

Has anyone had any luck yet? i left it till after new year as they said the bloke who sold me car would be back, i'm gonna ring today again and keep trying from now, i'm just wondering if anyone has had any luck with getting any money back yet?

The big problem with these type of people is that they know the system and have thick necks. So they know that the cost of chasing them is more than what you'll get in return. Worst of all is if you do actualy get them to the court room door (which is highly unlikely) they will just say O.K. there's your money back and even though you've spent £5,000 to get them there you won't get any of that back because, the court will say you are no longer at a loss.

 

I'm sorry to say it but they don't give a Flying. Maybe one of those watch dog programs can help and that won't cost you anything. No point throwing good money after bad:cry: sorry mate.

As a last resort, there's always the option of going there in person and 'explaining' to them the error of their ways. Helps if you know someone who will swear you were with them in Australia at the time.;)

 

I've had a couple of instances where a 'friend' of mine managed to get my money back with no hassle at all. (no hassle for my mate anyway, as he likes doing that sort of thing!:cool: :) )
