Just got a "NOTICE OF INTENDED PROSCUTION" through the door, for "camera-exceed 40mph limit" :mad:

 

i remember last sunday turning right onto a 40 zone and i was first at the lights so gave it a prod and maybe touch 50 or so, there was no one else around, i say this white van up ahead and just assumed it was a builders or something, then as got close theres a guy with a camera facing me, oh sh*t. Does this mean i will get a fine or have to go to court, never had any experience with traffic offences so kinda brickin it.

 

Any advice appreciated.

First thing to do is request photographic evidence. This does not incriminate you.

 

Secondly, once you receive the NIP fill it in, send it back but don't sign it. At present there is a loop hole which means that you can get away with this. (POSSIBLY)

 

TBH 50 in a 40 you're probably only looking at £60 fine and 3 points anyway, so it might not be worth the hassle.

Its the fact that they were on a dual carriage way on a sunny sunday afternoon, i understand the consequences that speeding can have but why dont they deter people in built up areas where kids often run into the road.

Because they make more money standing on a dual carriageway on sunny days, of course!

 

Have you sent it back? If not, request a new NIP because that one got wet / damaged / eaten by the dog anything and then fill in the new one and don't sign that.

Best thing to do is fill it out, photocopy it and burn the original, dont send anything back, and see how long ti takes them to reply to you. When they do, say you filled it out and have a copy for your records which you can forward to them. Then do that, hopefully it can be dragged out till its statute barred.

50 in a 40 will be 3 points and £40 fine if they decide to prosecute, they don't in all cases. (99% they do though)

It's quite obvious why they sit waiting at 40 mph dual carriageways located away from built up areas. They would not catch many drivers speeding around built up areas where children play as most drivers would realise the possible consequences of speeding in that scenario.

 

However, the cops and accompanying cameras will often be found on wide roads, preferably 40 mph dual carriages, where the road is pretty straight with unobstructed views ahead. This increases their catch rate immensely. They hide their van behind an oak tree on my usual route home from work. A few hours later they move 500 metres down the road where the dual merges into a normal single two-way road of 30 mph. They had me there once before and over the last week may have had me twice again possibly, my fingers are crossed.

 

Most of the 60mph A roads near me have been down-graded to 50 mph even though they are away from built up areas.

 

They are very cunning. I've been thinking about the speed camera problem and have a solution of sorts....No one will particularly like it though- even I don't like it. All drivers should protest by way of NOT speeding for 6 months or so. When the police realize they can't make easy money by this method they might concentrate on catching criminals.

 

If it wasn't the fact that I like cars and driving I'd give them up and start cycling but the government will probably start charging for that privilege too.

Still think my "blame it on a dead guy" theory has to work!!! Its dead simple just buy a local paper find someone who has died between the date of offence and today......and say they were driving!!!!

everyones always an expert when it comes to speeding tickets but has anyone actually tried the not signing it and sending it back routine? At the end of the day its your choice, if you want to try it and get hauled up in court and end up paying over 3 times the original fine then at least we'll all know that it dont work!!

I filled it in with the name of a guy who was test driving my car, which was up for sale at the time, though never advertised.

well i got the fine through the post today, 51mph in a 40, got a 60 quid fine and 3 points, so pretty lucky really, but there seems to be more and more of these mobile speed traps just lately, so im extra carefull at the moment, do i need to declare the 3 points to my insurance company now or when its up for renewal.
