Someone pulled out on my boy Bill tonight and altho Bill wasn't hurt bad his bike is a mess, the bloke apologised and gave him his name and number and reg of the car and said that Bill can either go through the insurance or the bloke will give him cash, Bill is taking the bike to our local bike place and getting a quote but if he goes through the insurance is it through the blokes insurance or Bills???

Can anyone shed any light i haven't a clue

Glad to hear he's ok Nics, that must have been a fright for you. Are we talking about a motorbike then? Only asking as I thought your kids were still young.

D'oh I'm having a bad day!! Didn't notice the thread title! oops. lol. I would say it'll be exactly the same as a car accident mate. Get him to contact his insurance and pass on the blokes details his insurance will sort it with there's.

Sounds like it was the car drivers fault m8, in which case it would go thro his insurance and not ur lads.

I would be inclined to pursue it via insurance tho tbh, that way he can't change his mind half way thro. Billy's insurance company will do all the chasing and it would be classed as a 'non fault' claim....he prob has legal assistance too?

If he has accepted liability insurance might not be needed if he is paying cash this can be a scam because your boy should tell the insurance company that he has been involved in an accident if he fails to tell the insurance company it can invalidate his insurance be carefull the cash may come and then your insurance company wont pay.

So best to get the blokes insurance details then and then ring Bills insurers and give them the info, is that right??

yep, that's the one.

The accident wasn't Bills fault so use the other blokes insurance but report it to his so they can handle it. But remember, even if it wasn't his fault, he will have to declare it for the next 5 years and it will affect his premiums. As for him not being hurt, wait n see how he feels tomorrow. Things like whiplash don't show immediately! Glad he's ok tho, that's the main thing.

He was knocked off his pushbike last year on a zebra crossing by a doctor!!! He got up and went to ride off it was only that a passing motorist said to him to wait for an ambulance to get checked out, he's a little tonka toy lol

I would, personally. There's no back-pedalling then when the repair bills start mounting....I'm a biker too of some 30 years. If he's been knocked off, it's a fair guess that his protective clothing has 'protected' him and also probably been damaged. As you will know, they're not cheap either...

food for thought 2k-3k for non fault related injuries

Bill wont care about that he'll just want his ped back on the road lol

I got knocked off my bike when I was a kid. Bloke in a transit opened the door as I was coming past and knocked me right off. He then proceeded to have a go at me for cycling down the road. Smacked the fecker in the mouth for that one and he picked himself up got back in his van and drove off. I was an angry 13 year old at the time..lol

Well their insurers have been on the phone this morning and they are accepting full liability, they are sending an assessor to check out the damage and arranging for Bill to have a courtesy bike while his one is being repaired, also sending out a questionnaire form for damages/expenses which will only be for a new crash helmet, as he hasn't got a job so no loss of earnings and its school holidays so no travel expenses but at least they're sorting it.
