Trading Standards called me today. The garage have responded to their letter, saying that they are willing to take the Saab back, in part ex for another car in their lot.

Hmm.

Trading Standard lady says that they are quite within their legal rights to offer me a replacement car of equivalent value or to give me the value that I paid for mine, off the cost of another one of their cars. She also said that this is an excellent offer from this garage, given we were expecting no response at all, and that if I reject this offer and pursue a refund, the onus of proving the car's faults lies with me, and I would have to pay for an independent mechanic for an opinion, stop using the car until court, and the judge could throw it out given they have made this offer. So, it looks like I have to accept this offer, provided they are offering a replacement of equivalent value....

BUT - not sure how I feel about having another car from this garage. Actually that's not true, I know exactly how I feel. But I also want a fast resolution given I start Uni in 2 weeks time.

So my thoughts are that I call the toss pots and clarify that they are willing to give me the value that I paid for the car in part ex for another car. If they agree then I have to take a mechanic with me - someone willing to fully check over the car and make sure the essential parts are ok and its not going to be another dog like this one. As it stands, I have been using the Saab for essential journeys, getting it into reverse, 1st and 2nd gears is still an absolute wrestle most of the time, and of course the climate control has never worked.

Any thoughts guys? Roobarb? I'm not going to do anything til Weds as I'm at work all day tomorrow, but I'm off Weds, and I finish work Friday, so I have all next week to possibly resolve this in between Uni registration etc.

Sounds like a plan if they have something suitable. I would go for it, especially as you have your mechanic mate. Can't be any worse can it?! At least you can wash your hands of the Saab

As long as you take a mechanic with you to check it out, just a case of having another car you might want. If its the only deal on the table with the best long term outcome then make sure you get something, that might be worth selling on, if you are not happy, rather than it being a sporty little number you fancy.

Rule with your head, rather than your heart this time.

Not much there I want to be honest. I paid a grand for the car, and we have more money to put towards another car, as we're down to one car between us now, so Marc's prepared to go in on this one.

Graham this was a head not heart car! I was hoping for it to be a decent, solid, reliable car with enough comforts and luxuries to keep me happy til after Uni.

I am waiting to hear back from the garage as to what they're prepared to offer me for my Saab. If its the price I paid then sure, we'll consider what they've got to offer. And we'll be taking a mechanic with us.

If they're only willing to give us their usual part exchange rate, then legally they're not meeting their requirements to offer us a replacement, in which case we have to pursue them through no claims court...

Its a pity you arent closer to me up here J !

 

My mate has a very clean 05 plate Hyundai something, and a stunning mk1 Mazda RX7, show condition for sale just now, and I know he needs the money !

 

This is not a dig at a sale by the way mods !:closedeyes:

 

Not much on his site I would fancy either !

My next call would be to consumer direct. Surely by letting you exchange the car they are accepting liability? Sounds mad to me that they are saying you have to take a car from them or risk getting nothing. Guess it's a decision you have to make if you want to risk it further :(

As per 1st post, it was trading standards I was dealing with, ie consumer direct - same people, different signage basically! Same staff tho!

I really don't know what to do, and Alan, that Primera's gone anyway

I can well imagine !! No chance of just selling the Saab on, swallowing a wee bit of a loss and start again ? I know it may sound like a bitter pill to swallow, but time is against you a wee tadge ?

It would be done with and although technically they have won, its less stress and hassle ?

Take the swap (Assuming they offer a straight swap/replacement and not a p/x) then sell it before you can discover any problems with it and grow a conscience about it, then buy something else from a better garage :D

Alan, we did discuss this at the weekend, its a possibility - and Alex yes we did consider this too - but their stock lists appear out of date and the ebay site doesn't match the website - and i really don't want any of the crap they're advertising....

Argh - gonna have to go there again, and I still want to smash his face in. Quite a lot actually

I'm not, but my mechanic Phil's agreed to come to view any cars they might offer me. I'm a member of Unison, so I will make some enquiries tomorrow with my rep to see if this is something they would assist with

Citizens Advice have taken the case on for me, have been corresponding with the garage, it was Citizens Advice who called me yesterday to tell me the garage's offer

i would take the deal being offered and get out of the saab. It could just be one of them cars which was probably part ex'd to them. Is there a time limit on there offer? tell them you will take the exchange there are offering but you currantly have nothing i like so you will keep an eye on there stock and get in contact with them when something comes up. Dont let them find you a car mind as they will over price it

Gonna go to the garage tomorrow, see what the actual offer is. They have a Nissan Almera (yawn) that'd do us for a uni car, thats a possibility, but if not we'll do the above
