Saab update, if you haven't all lost the will to live yet, like I have

After Mikey so kindly checked the car over this weekend, and found that it had no gearbox oil in it, (he added over a litre, the capacity is only 1.8l), the car has still been a mare getting it into reverse, and its also beginning to crunch a bit putting it into 1st and 2nd now.

Took it back to the garage today. Accepted that they have fixed the oil problems and told them that we had an independent mechanic look it over and confirm the sump has been off and the work's been done. However I referred to the letter I sent him and his written response and how he hadn't actually replied to the issue of the crunching gears.

He told me that he'd had the car back twice and "has never had any problems with it" and therefore refused to do anything else with the car (erm, hello, air con?!) I tried to ask him if he thought I was making this up and did he not think I have anything better to do with my time than take days off work and drag my 5 year old daughter to garages with me, but he just kept talking over the top of me until in the end I lost my rag and banged my fist on his desk and shouted "Will you JUST LET ME FINISH?!" - at which point he just said "well you've just blown your case now haven't you?" and smiled smugly at me. Had to leave coz I was so close to properly blowing my stack (it doesn't happen often but f**k me when I lose it I REALLY lose it), so Marc tried to negotiate with him and say do you really not want to try to resolve this with is and he just saying "take us to court".

Still shaking with anger. I'm not a violent person but if Tash hadn't been there my god I'd have wiped that smug look off his ugly, scarred fat head. No wonder this garage employ a security guard.

Sooo, took it straight to the Saab garage, and have booked it in for a "health check" on Friday. I spoke to them at length about the issues and they said they are happy to give the car a thorough once over, and most importantly, give me an opinion on the gear box. By the way, I told the idiot I got the car from about Mikey finding no oil in the gear box. He said it wouldn't affect the car going into gear as its synchro driven. Relayed this to the man at Saab who said, "why on earth does he think we put oil in the gear box then?!".

Can I get a "FFS" please?

Oh, and we might be moving house in a few weeks, just in case we don't have enough stress.....

Again, have you got in contact with car/house insurence if you have legal cover to see if they will fight this for you?

I get legal cover through my union, so I'll contact them. I've spoken to Trading Standards again and they have said they will now intervene on my behalf (although typically the lady who has taken on my case is on holiday now for 2 weeks). So the next step is for them to write to the garage on my behalf to try to resolve things. If that gets us nowhere, then Trading Standards appoint an independent assessor who inspects the car and gives a verdict, and then assuming the findings back up my claims, I then have to take them to court. Which of course will cost me money, which is why he's sitting back smugly telling me to take him to court, coz he thinks I won't because of the costs.....

The Small Claims Court deals with claims under £5,000 and if you can fill in forms, keep documentation, it's not a bad way to go. Did it myself with a bodged job on the Silver Zed and got a result. The first leaflet is http://hmctsformfinder.direct.gov.uk/courtfinder/forms/ex301_web_0510.pdf and the general advice about the whole thing is here http://www.direct.gov.uk/en/MoneyTaxAndBenefits/ManagingDebt/Makingacourtclaimformoney/DG_195639 and you can even start it all online here https://www.moneyclaim.gov.uk/web/mcol/welcome

Good Luck.

Super surprised you kept your cool, I'd have clocked him one for sure, then another, then another........ you get the point. I can't stand smarmy gits who know full well they've ripped you off but because the police will not do their jobs anymore (Upholding the law is their jobs, before anyone says otherwise!) they know it'll cost you too much to take it to court, arseholes!

On my police comment, in the old days you could walk up to any beat copper, and they would happily come with you to try and sort out any breach of the law, including things like this, these days, no one has any respect for the law, the police or the courts, and the police seem like they can't be arsed, just dismissing everything as "a civil matter"!

I know it's easy to blame the Police but the courts decide what's a civil matter, so what do you want the Police to do :( Once the courts get into the real world and punished people, then the Police might be able to take action with people...........

Janus, I think you've been more than patient but I don't understand why you didn't stick to getting a refund? Small claims court isn't as daunting as it may seam. You can do it online and you can track it online also. Just start putting everything in writing to the garage cos you've been too nice ;)

The garage have refused me a refund! I asked for one in person, and they refused. I went to Trading Standards, who gave me a letter template to use, which I did, outlining my complaints, and asking for a refund. They wrote back refuting all my claims. They are now refusing to sort the issue of the knackered air con which they said they would fix prior to me even getting the car, and despite them telling me they have ordered the part, they have not responded to my question about when this will be done. So today I went in again, told them of my outstanding issues and asked for my money back, and was told to take them to court.

Alex, if Tash hadn't been with me, I'd have jumped over the desk and kicked the smarmy c**t in the knackers. I'm sure its Kaza Steve on here who knows these toss pots and says his friends have given em a hiding in the past for their business dealings. Like you said Alex, what sort garage employs a security guard? Its not like they have a showroom of pristine, top of the range cars.....

B0ll0cks

In the old days, the courts didn't even need to get involved, the copper came with you and told the garage to give you a refund and stop being a ****er, these days they just don't bother, because the courts have gotten so ridiculous that no one respects the law.

A few years ago I was beaten up by a group of bouncers, I had done absolutely NOTHING, but one bouncer decided he didn't like me, started a fight, others as you would expect came to his aid when he was losing and decided to ask questions later, the police came round, looked at and photographed my cuts n bruises, promised me action, then said the CPS refused to prosecute the guy, because he was a bouncer and it was his word against mine!!!!! So that was that, case closed! WTF happened to MY decision to press charges against someone who ****ing assaulted me? The police are worthless and pointless, why do I pay my taxes?

/EndRant.

I hope you get this sorted Jane, it's making my blood boil.

asked for my money back, and was told to take them to court.

You have no idea of how smug you can feel when you walk out of court having taken on a motor trade arthur daley who said "see you in court" and won. :devil2: I recommend it. It can be done as long as you are careful with documentation and fill in forms and have a case.

Not defending the police (god forbid) but happen to know that the police morale is at an all time low because despite a lot of their hard efforts catching the baddies, the effing CPS throw out most of the cases the police take to them. Tash's dad (my ex) is a police civilian and he collects and collates evidence for court and the CPS. He says that even when it appears to be an open and shut case with clear evidence, the CPS throw out the case. Must be VERy frustrating for the average copper.

And thanks, I appreciate the support. I am just so sick of it all. I said to Marc earlier, I hate cars. I don't even enjoy driving at the moment. It used to be one of the things I lived for....

No-one likes being ripped off but there is nothing quite like having the image of some smarmy far tw@t salesman burned into my memory as he shrugged his shoulders, dismissed my concerns and said "see you in court" - soooooooooooo angry :censored::censored::censored:

Tell you what, take an iPhone or similar device in there, with the voice recorder turned on, keep it in your pocket, or in your hand but with the screen off so he can't see it, then just remain calm, ask him straight, things like:

So you're refusing to give me my money back?

You're refusing to look at the problems with the car?

You're refuting that you originally said you had ordered a part for the air con and would fix it?

etc.

then when he's finished, smile, turn round, walk out and say, "I'll erm, HEAR, you in court"!

Isn't that illegal? Stupid law saying you can't record someone without their permission so you couldn't use it in court :(

Think that only applies to electronic communications? I don't see why you can't record one of your own communications that occurs in a public place.

You thinking what I think you're thinking?

Its not that the police dont 'bother' - they will. I know for sure that they will go out their way to resolve matters outside the criminal aspect. However if the idiot does not cooperate there is nothing the police can do as it is not a criminal matter.

If it was CPS who made the decision...why are police worthless?? Do you not think the polcie are extremely frustrated by the amount of times they will do all they can to get someone to court and the CPS wont run with it?

Anyway, back to the original topic...

As long as you are willing to put in the effort, you should be able to achieve the results :thumbup1: especially if Mikey can put in his word to prove the condition of the Saab.

I said that too, know a few coppers and police civilians, they're all sick of busting their balls and having the case thrown out by the CPS.

Thanks re my car, like the lady in Trading Standards said, there's no fast fix for this now, so I gotta do this by the book. Hopefully the Saab dealers will at least be able to give me an idea of the extent of the problem, and the Trading Standards officer said she thought this was a really good idea. Will let you know Friday when they've looked at the car....

I'd say get your car sorted or scrapped, whichever is most cost effective and then just wait a little while until the garage have forgotten about it, then start a campaign of dark, sadistic, totally over-the-top reactions - which culminates with the smug arfur daily type exploding with a 34lb firework planted in his rectum.

That's always one of my favourites!

Each to their own though..

You been on the wacky baccy mate?!! Lol

I wish!

Drugs are for mugs - make sure you tell your kids!!

There's just this part of me which wants to release my inner psychopath - I try to ignore it most of the time, then find myself trying to get to sleep while thinking of inhumane ways to torture people who have wronged me.

I think its just a release method - but quite effective. Give it a try, it might help you to relieve some of your stress??

People seem to have missed my point, but that's not unusual, I'm a programmer and think logically to the end, so to put it in plain English, the Courts are useless and the CPS are idiots, nothing ever gets resolved because of both of them and that makes the Police Worthless.

If they are unable to do their jobs and get things resolved, and achieve justice, then they are also, pointless. I have a friend who is an officer in the MET, he has a similar opinion, I also know several people who used to be "Hobby Bobbies", that left "The Force", because "there is more force in a blender than the Police these days", mostly thanks to the CPS and the courts, hopefully that's a few shades of mud clearer?
