a week ago - along with additional £40 to get air con regassed. This is the issues thus far:

 

1. Car test driven 27/06/11. £200 deposit taken to hold car. Climate control not working – agreed to pay £40 in addition to £1000 asking price to pay for air conditioning to be re-gassed.

 

2. Purchased 30/06/2011. On date of purchase air conditioning was still not functioning. Was advised by Darren that the air conditioning condenser needed replacing and that the garage would order the part and resolve this issue at no extra cost.

 

3. On date of purchase, after app. 5 miles of driving, oil warning light came on the dash and warning alarm sounded. We immediately returned the car to the dealer to ask them to resolve the problem. Darren test drove the car and then topped the car up with some oil. He said his colleague should have done this before the car was handed over. He did not have enough oil for the car and that we should go to buy some. When we asked whether this was appropriate given that we had just purchased the car, and suggested that in fact, it was the dealer’s responsibility to ensure the car was in a fit state to be taken away, he was rather rude and swore at us. After some discussion we took the car away without enough oil in it. At this time, the engine management light came on the dashboard, and we had to immediately return the car back to the garage. At this point Darren got back in the car and drove it away. He was gone for over 20 minutes. We were unaware of what was happening at this point. When he did return, it was in a different car, and our car was nowhere to be seen. He told us not to worry and that he had taken our car into a garage for a repair. At this point we had no means of transport to get home and collect our daughter from childcare. Darren then went to see someone who gave us a lift home.

 

4. On the afternoon of 01/07/11 we had a call to say the car was repaired and was “running perfectly”, and would be safe to drive to Staffordshire.

 

5. On 02/07/11 we drove to Staffordshire. The car developed the oil light problem and warning alarm on the journey there, and was problematic intermittently over the course of the weekend. I advised Darren at the dealership via text message on 03/07/11.

 

6. On 04/07/11 we received a text from Darren to say we could take the car back on 06/07/11 for further investigation

 

7. On 05/07/11 the car’s engine became much noisier and the warning light and alarm also came on again. Darren and his colleague agreed to collect the car for repair. I asked them to keep me informed as to what was happening.

 

8. On 06/07/11 Darren’s colleague arrived at our house with the car. He said that they had not found any fault with the car and no further repairs had been carried out. He did not mention at this point when the climate control on the car would be fixed. However on driving the car, the oil light and warning alarm fault is still apparent, intermittently.

9. On 07/07/11 the car’s engine is sounding “rough” and the oil light and warning alarm are still present. I have text and called the garage to advise them of this but have not had a response as yet. We have owned the car for a week and so far have been without the car for half of this time, and on the days when we have had the car, it has been driven with a fault. Are we within our rights to request a refund? We feel we have given adequate opportunity for the car’s faults to be rectified.

This is without mentioning the time I've had to take off work to drop the car off, be home for them to collect it, as well as not having a working car for the week of ownership.

Oh and it DOESN'T have full main dealer, it hasn't been serviced in almost 3 years - my bad for not thoroughly checking everything fully

Oh and tonight I went to take the car to Tesco, could not get it in reverse. It crunched and crunched but would not get in - so another major fault. At this rate I'm never ever buying another car

The only thing i think is you didn't spend much so you cant lose much no offence but it could have been worse you could have a 10-15 grand car with issues.Thats the way i look at it rightly or wrongly but hopefully your be sorted.

Might be an idea to buy a car thats suited too you, that runs fine, doesnt need much doing too it. and keep the bloody thing for a while, the more you buy the more you run the risks of this happening.

 

I agree with Ian. you cannot buy and sell as many cars as you do and not get bit on the arse every once and a while.

But thats relative really, dunno how Janus sees it, but for me that would be a large chunk of cash.

Yep for a car its not a large amount, but tbh I have bought £300 bangers that have been trouble free for a year or so.

Its not so much the amount spent, as the dealers apparent unwillingness to agree to resolving the issue amicably thats the issue here I think ...

Thanks again for the replies. The plan WAS to keep this one long term - it ticked all the boxes, was the spec I was looking for in a family car without being a bloody MPV, bodywork great, on test drive it seemed fine apart from the air con not working - really did think this one was a "keeper" after all the ones I'd tried and not liked since selling Zedward. And yes £1000 is a LOT of money to me. I'm a medical secretary, just about to leave my badly paid job and earn even less for the next 3 years training to be a nurse. As much as I want another Zed (LWB), what's a grand -£1500 gonna buy me apart from a whole other heap of trouble, unless by some miracle I get another amazing one like my old shorty. What I need is a car that is going to be a good, family car that will serve me for at least 3 years. I have a budget for wear and tear repairs, etc but intermittent engine issues and now gearbox issues from a car I just purchased, I just don't need the chew. And Gary you are right, I have no idea if this is going to be botched, whether the repairs will be guaranteed, and whether if they do say they've fixed it this time, if they'll try to wash their hands of it.

So, my plan is to fax a full letter to Trading Standards on Monday, detailing EVERYTHING and asking for some urgent advice.

Man, this really does suck. Had to borrow Marc's mum's car to do the grocery shop earlier and her bloody clutch is sh@gged so that was a stressful journey too!! Got some emergency chocolate tho hahahaha, I NEED it!! And wine.

Oh and to top things off, I got the mushy peas out the microwave and they erupted in my face, so I've got a really nasty painful burn on my right eyebrow and lid. Pfft to everything!

Ok take a look at these few photos, this is of my pug 406, 1996 2 litre turbo petrol, (150bhp) exec, it had total closure factory fitted alarm, driver and passenger air bags, A/C fully working, electric seats, heated seats, heated wing mirrors, 6 disk CD multichanger in the boot, CD player as standard in the cabin, full cream leather interior, it did 35mpg, auto windscreen wipers (would turn on when sensed rain) Front fogs, everything worked fine on it, the only thing i needed to replace when i first got it was the exhaust system due to being caught on speed humps. i ran it for 2 years with out a hitch, even drove a 16 hour drive up to the isle of uist just off the coast of the isle of Skye and then back again

I paid £200 for it, as it had no tax or MOT, and after i replaced the exhaust system, it flew through with no advisories. in the 2 years of owner ship, not a thing went wrong with it (regret selling it actually).

 

When i hear someone say "you get what you pay for" i don't aways believe that. some times you get a lot more than what you pay for.

 

Now thing is, that was a £200 car, Now if i was looking at a car that was advertised with A/C as the one jane bought, if it was advertised with full dealer stamps, and there wasn't, just like the one jane bought, and it went wrong not long after getting it, say in the first week, and they kept fapping me about saying it was fixed when it wasn't. id be very pissed, especially in todays climate, £1040 is a lot of money, i dont care how much you earn. It Doesn't matter what you paid for it, the fact of the matter is, it wasn't a private sale, it was a business sale and falls under the trade descriptions act.

 

But, im not going to say Jane was completely innocent in this, had she questioned why SHE needed to pay for a re-gas of the air-con on a car she was purchasing, especially when it stated in the add that it had A/C, to me, that would of set alarm bells off instantly and i would of walked away.

 

What the garage is doing she bought it from, is basically taking the P, they know it, we know it, Jane knows it, cost isnt the issue here, the practice with which the garage is using is.

 

But, i stand by what i said, Jane needs to settle down with a decent car that doesnt need a lot doing and keep hold of it for a while.

My mam and dad bought a car from them and paid £100 deposit, I had alook and there changed there mind, he would'nt give the money back and it was less then 24hours later,

cleveland car circus are well know clowns and rougues ,........the pair of them have had more kickings than a football and they are just imune to it now,..... they are about as hard as philadelphia cheese.....ive seen Darren crying like a baby in town when pulled and " questioned" by a few of my friends regarding deal he did that was not so friendly...

 

their web site is missleading and false and should also be brought into question when talking to the fair trades officer or trading standards .....those muppets let themselves down each time by trying to be the big hard men and threatening and being bullying ..my advice ..borrow a digital voice recorder when you go next time and record everything they say .....its amazing what crap they come out with that could be usefull for you to go to the police with if they threaten you or try to bully you ......dont be put off by their wide boy appearance ..stay calm and cool and make a HUGE scene each time you go in..especialy when other buyers are in ......only way to get them is in their pocket ....good luck

I was unaware of that. Planning on speaking to Trading Standards tomorrow, I've got a point by point list of the issues I plan to fax to them and hopefully get it resolved.

Did that with a cup of coffee once, it was fine until i gave it a stir then it erupted out of the cup all over my hand :blushing:

Unfortunately garages range from professional outfits with reasonable service to shady ones with none. I've suffered major rip offs before, worst being when I refused to pay the outlandish charges for minimal work 3 heavies tried to fight me for cash and wouldn't let me near my motor to inspect the work, a day after the owner was taken to jail for other illegal dealings. Irrespective of this, the best attitude is to be confident, dont back down and make your intentions clear immediately. If they make excuses, no is a very powerful word to return with. No beating around the bush, just 'no'. Good luck, when they call I would say 'no' I want my money refunded on Friday etc. when I shall come for the cash. Then rid yourself of the problem :)

If you have legal cover on your house/car insurance call them and tell them about the whole saga and if see if you're covered for them to act for you and get your money back.

 

90% of policies will give you legal cover for things like this if you bought it.

 

Advise the garage if they call or text or contact you in any way you are no longer dealing with it until a full refund is issued and they need to contact "Law Firm Bla Bla Bla" for any future correspondence as they are now dealing with it and they will be in touch shortly.

 

Any questions the garage have about why or wanting to ask anything just say “you have the details of my lawyers any questions can be answered by them, thank you.”
