a week ago - along with additional £40 to get air con regassed. This is the issues thus far:

 

1. Car test driven 27/06/11. £200 deposit taken to hold car. Climate control not working – agreed to pay £40 in addition to £1000 asking price to pay for air conditioning to be re-gassed.

 

2. Purchased 30/06/2011. On date of purchase air conditioning was still not functioning. Was advised by Darren that the air conditioning condenser needed replacing and that the garage would order the part and resolve this issue at no extra cost.

 

3. On date of purchase, after app. 5 miles of driving, oil warning light came on the dash and warning alarm sounded. We immediately returned the car to the dealer to ask them to resolve the problem. Darren test drove the car and then topped the car up with some oil. He said his colleague should have done this before the car was handed over. He did not have enough oil for the car and that we should go to buy some. When we asked whether this was appropriate given that we had just purchased the car, and suggested that in fact, it was the dealer’s responsibility to ensure the car was in a fit state to be taken away, he was rather rude and swore at us. After some discussion we took the car away without enough oil in it. At this time, the engine management light came on the dashboard, and we had to immediately return the car back to the garage. At this point Darren got back in the car and drove it away. He was gone for over 20 minutes. We were unaware of what was happening at this point. When he did return, it was in a different car, and our car was nowhere to be seen. He told us not to worry and that he had taken our car into a garage for a repair. At this point we had no means of transport to get home and collect our daughter from childcare. Darren then went to see someone who gave us a lift home.

 

4. On the afternoon of 01/07/11 we had a call to say the car was repaired and was “running perfectly”, and would be safe to drive to Staffordshire.

 

5. On 02/07/11 we drove to Staffordshire. The car developed the oil light problem and warning alarm on the journey there, and was problematic intermittently over the course of the weekend. I advised Darren at the dealership via text message on 03/07/11.

 

6. On 04/07/11 we received a text from Darren to say we could take the car back on 06/07/11 for further investigation

 

7. On 05/07/11 the car’s engine became much noisier and the warning light and alarm also came on again. Darren and his colleague agreed to collect the car for repair. I asked them to keep me informed as to what was happening.

 

8. On 06/07/11 Darren’s colleague arrived at our house with the car. He said that they had not found any fault with the car and no further repairs had been carried out. He did not mention at this point when the climate control on the car would be fixed. However on driving the car, the oil light and warning alarm fault is still apparent, intermittently.

9. On 07/07/11 the car’s engine is sounding “rough” and the oil light and warning alarm are still present. I have text and called the garage to advise them of this but have not had a response as yet. We have owned the car for a week and so far have been without the car for half of this time, and on the days when we have had the car, it has been driven with a fault. Are we within our rights to request a refund? We feel we have given adequate opportunity for the car’s faults to be rectified.

This is without mentioning the time I've had to take off work to drop the car off, be home for them to collect it, as well as not having a working car for the week of ownership.

Oh and it DOESN'T have full main dealer, it hasn't been serviced in almost 3 years - my bad for not thoroughly checking everything fully

Oh and tonight I went to take the car to Tesco, could not get it in reverse. It crunched and crunched but would not get in - so another major fault. At this rate I'm never ever buying another car

Not exactly a Mikey Bean? I'm not sure if you're thinking he's huge or tiny, either way, I've seen the man with a torque wrench, and it's something to be very afraid of if you're not a car! :D

You as the customer has the law on your side. I was a car sales man for 5 years and the customer has more power than the seller. First question is, is there, for spares or repair or spares only etc etc anywhere on the invoice? If not i belive the garage have to give a 6 month major defects warrenty on any vechile they sell. You have to take the car back to them as you have to give them resonable oppotunty to fix the car which i belive is 3 times per problem. There is no point trying to claim for travel costs as how far you live from them is out of there control.

 

Im 99% sure that all sales from a pound to a million pound fall under the sales of goods act and that you have a 14 day cooling off period but Best to speak to trading standards as they will give you the best advise.

 

Biggest advise i would give you, although tempting is to NOT lose your temper, shout and a scream at them as that will get you no where and there less likely to be of any help to you. Also try to keep a record of all messages and phone calls incase you need to go to court but i would say they dont have a leg to stand on and they probably know it.

 

If you do your research ie trading standards and consumer credit etc you wont have a problem. I would recommend you take nothing less than a full refund now (£1040) as this car will be one problem after another.

Yeah, you have all the rights in this case Jane and don't et them fob you with any crap. Private sales are different, sold as seen. Dealer sales must make sure that everything is above board as they are legally trading as a company.

Thanks all - and Dave, I have been on the Trading Standards website and I most definitely have a case here. I'm not one for losing my temper and shouting and screaming - its one of the reasons why Marc is staying home with Tash tho as he might well kick off. That and I don't want to drag my 5 year old there to have to all walk home as its a fair trek for her little legs.

Really don't need this at the moment!

Ps thanks everyone for your support. I'll be going down to the dealers this morning. I'm leaving Tash with Marc, and I won't be coming home until I have my money back. Its times like these I wish my dad didn't live the other end of the UK, I could do with his back up. Built like a brick sh1t house and doesn't take any crap from anyone lol. Still, I am a diplomat and a talker, so I shall just explain my rights and not move til its sorted :gunsmilie:

Good luck. Be polite and explain your point, if they don't play ball tell them your intentions for the legal route and the next step is to start putting things in writing and sent by recorded mail. If it does end up in court, you want to show that you were reasonable and gave them every chance to put things right.

That's what I'd do as well - if the dealer has a reasonable reputation to protect then for the sum of money in question, it's probably less hassle for him to take the car back and refund your money.

 

You have certainly gotten through a few cars this year Jane; and law of averages/probability etc suggests one would turn out bad.

 

Live and learn I guess - that's what teaches us to be wiser next time.

 

Still with all this experience, maybe you should take up car trading to see you through college.......:wink:

I took it back today. Drove down on my own this morning. The bloke initially said I should take it back on Monday and they'd look at it. I explained I wasn't prepared to drive the car in it's current state and that in fact I wanted my money back. His immediate response was no, I am not giving you a refund and he disputed that there was any fault with the car. He said that he had the car 2 days this week and drove it without fault. So I explained the fault was intermittent and that I was also now having problems getting the car into reverse and when I started it up this morning black smoke came out the back. He said again I was not entitled to a refund and I said that I had been in touch with Trading Standards already who had advised me that I was entitled to a full refund, as I had given the garage equal opportunities to correct the faults. I also explained that I was not in a position to be able to be without the car periodically whilst they tried to resolve the issues any further as it was a major inconvenience to me. So,after this discussion, he kept the car and said that he would take it in somewhere and if the fault could not be fixed I could be refunded. He said I could not have a refund there and then as he didn't have the cash and a cheque would need 2 signatories and his colleague is on holiday this week. So reluctantly, I have left the car there, and will await word on Monday. In the interim I will turn my list from my initial post, into a formal letter, to fax to local Trading Standards on Monday and CC it to the garage, with all the updated info from today's visit.

Might be an idea to buy a car thats suited too you, that runs fine, doesnt need much doing too it. and keep the bloody thing for a while, the more you buy the more you run the risks of this happening.

I think you have done the right thing if you want to go by the rules. Hope you got a spare key though like Vodka says? Just to keep a little leverage anyway.

I feel so sorry for you,i had an experience with a Bmw that i found to be clocked and a fake service history, wanted a refund ,never got one and lost £2ooo when i sold it 3 months later .My wife thought i was going to have a heart attack i was so stressed.Hope it works out for you.

Keep at it, sounds like you are doing it all properly, so hopefully they won't have a leg to stand on, keep us updated with progress.

Problem is now, you've no idea if he's going to bodge it :(

 

I personally think you're better off pushing for a refund but you're in a difficult position. Maybe another option is if you took it to a garage of your choice and they picked up the bill?

 

Another thing is it might be an idea to insist on a warranty on the engine - say at least 3 months. What happens if he "fixes" it and in a months time you have the same problem. Think it would be extemely difficult to get your money back then :(
