Its another rental property nightmare :cursing:

 

I got a call from one of my tennants saying that her partner had lost it and tried to rape and kill her. Apparantly they had not been getting on very well and he had agreed to leave in a week or something when he came home drunk and tried to rape her. He then started smashing the place up, she managed to call the Police and run outside.

 

The baby was inside the house and he was screaming at it while smashing stuff up. When the Police arrived he would not open it so they smashed the door down.

 

I went out there and the double glazed door is ruined and there is a lot of damage to the property. I have Landlords buildings insurance but am not sure if it will cover the damage as he was a "guilty party" and the child was in danger... any ideas?

 

Next thing is that she has been advised to change the locks by the Police so she asked me to do that. I changed the locks but he is the earner/rent payer so I am now not going to be paid any rent.

 

The DSS told her to stay there until I evict her for non payment, and that I will have to take her the whole way to court until they re home her... what a country we live in :helpsmilie:.

 

I am sick of owning rental properties to say the least I would sell it if the market was better and I did not have redemption penalties on the mortgage grrrrr.

if she is not on the lease then chuck her out, she is trespassing, as for non payment, she is in her right to stay withput paying till you take the court route which will cost you a fortune its shit aint it, i would threaten her with court action for the damage they caused, might make her do a moonlight

 

as for insurance i doubt they will pay, they will say its a civil matter and you have to take the guy to court for the damages

They had a joint tennancy that expired a few months ago so its technically "squatters rights I believe" so my understanding is I can serve a two month notice to quit, then have to take it to court to get the house back.

 

It so sucks this whole mess is very stressful as you literally have to pay for the right to watch someone destroy your property and cost you money while you run up legal costs to try and get it back. Then after all that I have to pay to fix the place up again and it was immaculate... oh she did not have the money for a new front door so I have to pay £600 for that as well on Monday to add insult to injury.

threaten her with an attachment of earnings for the damage, its a court order that takes money from her benefits or wages before she gets her hands on it, it will take years to get your money back but it will annoy the fook out of her and might make her move out

Cant you have him charged for any of the damage. I know you want her out but to be fair(ish) it wasnt her thats done the damage ( although i understand she is still liable).

Hope you can get it all sorted.

But not too sick to go out and get pissed, Not to sick for sex if he tried to rape her, and not too weak to smash the place up..... Get him done for benefit fraud !

unfortunatley you have no choice legaly but to wait and go the court route however you can when she leaves the property for any time move back in and change the locks ...if she is living there under squaters so called rights..if the property is furnished and the furnishings belong to you then she has no right to be in there without your consent ..as its not an empty dwelling ....move a mate in there temporarily until you can re rent it ..she is then the DHSS's problem and there is nothing the police can do ..make sure all her belongings are removed and secure and not damaged ..dont forget you have rights too

As said above - I'd wait until she went out and go back in and change the locks once more... even if you have to pay a solicitor to defend you, if it comes to it, at least you can fix and re-let the property and also avoid any more trouble when he inevitably turns up again!

I would play the good Samaritan. Approach her and tell her you are concerned for her safety. Say you have another property close by that would keep her out of harms way while she gets things back on track. Arrange for a van to load all her posessions into and then drive to a layby in the middle of nowhere and dump her stuff there.

 

She wanted to move... you wanted your house back. Noone forced anyone to do something they didnt want to. Everyone's a winner. Just have to live with a guilty conscience for a while until you get over it!

 

If she doesn't fall for that, then I would change the locks the moment she steps outside the house. If she wants to get back in she can pay for a new set. Fookin scroungin toss bags.

I was hoping to buy my first house this year for a rental, but your sort of putting a downer on it now. I thought that if she's on benifits then the DSS pay for housing, or is this all just something i made up in my head?

housing benefits are paid direct to the land lord as far as i know, if she is claiming benefits then she can get housing benefits, as far as i know they can pay up to all of any arrears if she has been claiming. but i think arrears and such depend on circumstances, i would get the court order or even a solictors letter to warn her of the consquences of fraud and squatting, also might be worth putting a call to social services about this and endagerment to her child from him, they might try and move her if they think there is a problem.
