Parking Fine- advice please.

Got parking ticket but didn't pay before the reduced price deadline so should pay £70. When I paid the fine I was asked for £35 not £70! Paid £35- result I thought.

 

Now got letter from council (Notice to Owner) requiring I pay the fine in full. I have noticed that they now state the wrong road name- only one letter different Bridge Street not Bride Street.

 

Can I get out of paying the additional £35 as I wasn't in Bridge Street?!!

I could'nt say anything definate - however i can tell you that hell yeah give it a shot, nothing to lose! My dad fights everything! And its surprising what you can get away with so to speak. Give it a go mate, at the very least you'll inconvinience them! :D

Fooking right argue the the toss, and take the matter to court if needs be, firsty they gave you the fine amount of £35 not £70, secondly you paid what was asked, their error, 3rdly the street was written incorrectly on the ticket, this, if it went to court would throw the prosecution case out, as it has to be prooved beyond reasonable doubt.

Speak to local citezens advice and see what the best course to go it.

I seen alot less thrown out due to incorrect forms and details filled in.

The ticket was correct- its the recent demand for the 'missing' £35 that has the wrong road name.

They're fault they didn't charge you full at he start! Tell them that's all you were told to pay you did your part there f**k up they're problem!

Also if he road name isn't correct then they haven't a case as the details are incorrect!

If your a pain in the arse they will probably just drop it as its an inconvience to them!

\IS this the council or private firm? If private wait for the DVLA letter and write back saying that they need to pursue the driver and you are unsure who was driving that day. No responsibility to supply the drivers name to a private firm. If it's council there are different rules and it could be points and a fine for non-disclosure as with speeding, but chances are if the road name is wrong and you were unsure who was using the car as it's been so long then it'll be thrown out of court if it got that far. do a search on the net for get outs. I had a private one before chrimbo for parking in a supermarket and not using the store...just waiting on the letters if i can be bothered.

 

However, I have tried the excuse with my local council once that i had a migraine and it was unsafe to continue driving, so i parked the car up at the earliest opportunity. I realised this was illegal, but it was all i could do in the interest of saftey to other road users. I called a friend to collect the car when i arrived at home/work, but by the time he got to it the ticket was already issued... Somebody told me to try this as he had done it and sure enough i got off on appeal!!! Just depends on whether you want to admit guilt and chance your arm, or try any play the system if it's a council ticket...

I had paid £35 (should have been £70 but they only asked for £35) - now they've written wanting the rest but have quoted a different street name in error (spelling is wrong).

Just write back and say that you were not even parked in that street at that time and you can prove it. That'll confuse the hell out of them!!

 

If it were private, then i'd say just ignore it then and tell them you paid the £35 on X date if goes to court. It'd get thrown out anyway, but for that amount is hardly likely to go to court. Council is different though and they have more rights. Also, if it's your own local council they'll have you on file for council tax etc as well...

 

I would ignore it though and it might go away. if another demand letter arrives, say that you've been in Austrailia for 3 months and then appeal to them on the grounds that you paid what was asked 3 months ago and thought it was a fine for the same ticket again! Hardly likely to bother chasing you for it really and are just chancing their arm for the sake of a letter thinking your loaded and will just pay it maybe!

 

read my recent insurance post...I e-mailed them back asking for more info and now their £20 demand has suddenly faded into the background...
